The Constitution Strikes Back!

No, this is not another Star Wars episode like "The Empire Strikes Back," but its impact is just as dramatic. The Supreme Court in a 9-0 decision struck down Colorado's unconstitutional attempt to remove our 45th President from the election ballot in November. This is a not only a big win for our Constitutional Republic, but for American citizens too. Democrats and the Biden administration's attempt at weaponizing the government and trying to play politics with an election has been derailed. To deny people the right to choose which candidate they prefer, smacks of something done in Communist, Socialist and Third World countries. Not the United States! Democrats illegally tried to use their phony insurrection impeachment scam as justification for removing our former president from the ballot but forgot two important facts. The ex-president was never charged or convicted of insurrection. Now, with this decision, Americans can decide our election not a particular group of states as it should be. Although I'm sure the disgusting behavior of the Democrats will continue, as they will try to find another way to "Shanghai" the November election. Photo: Inc.Magazine

That stood no chance. Under American law, everyone is innocent until proven guilty. There has been no conviction yet on which to base a disqualification. Yes, even politicians that people hate are innocent until proven guilty.

Precisely stated The former president was not involved in insurrection until he is tried, and a judgement is made by the court. . No one state has the right to make up a reason (insurrection) to exclude a candidate from the ballot and give an advantage to their opponent (Biden). The 9-0 decision upheld that view. Furthermore, citizens have a right to choose their presidents, not state legislatures. Anyone with a bit of common sense would understand this ruling.

Voting has become a joke. I'm glad that state did the right thing. Due to our freedom of Speach, no one could prove beyond reasonable doubt, former President Trump did anything wrong in reguards to Jan 6th. Yeah, the democrats have nothing.

Furthermore, citizens have a right to choose their presidents, not state legislatures. As far as your comment about January 6th, your right and make a good point. Congress voted to impeach but he never was... Somewhere, the words "Peacefully and Patriotically and march down to the capitol" and make your voices heard was omitted at the witch hunt of an impeachment trial.

As I stated in my post the word disgusting is my opinion of the behavior of the Democratic party. What does the court of law have to do with the use of that word? Ridiculous is another word one can use to describe things. Like these ridiculous comments you just made. Spare me the holier than thou, self-righteous attitude.

Actually the Constitution didn't strike back. The US Supreme Court basically rendered the 14th Amendment useless when it comes to those who engaged in insurrection. The majority said that states can only disqualify *state* candidates who were involved with insurrection. They said that the legislature would have to enact a law to make it applicable for federal candidates. That being said the 9-0 verdict was widely expected. What was a loss for Trump was that the Supreme Court declined to address whether or not Trump was an insurrectionist. His team explicitly asked them to rule on that and they didn't touch it with a 10 foot pole.

Actually, you are wrong as usual with your assessments. Of course, when you listen to mainstream media talking points from CNN or MSNDC, or whatever leftist propaganda sources you use, this is the nonsense you will come up with. These sources are just trying to spin a "just decision by the court," hoping they gaslight liberals like you so you can save face, while in reality the networks are going out of their minds over the court's decision going in favor of the former president. The 9-0 decision wasn't widely expected although as a constitutional issue it should have been. That's why the networks freaked out, and when it did happen, they tried to explain it away as a majority 5-4 decision. The point of my post is all the states are part of the electoral college and have electors who vote for president as determined by "THE CONSITUTION." The number of electors is determined by each state's population. No one state has the right to make up a reason (insurrection) to exclude a candidate from the ballot and give an advantage to their opponent (Biden). The 9-0 decision upheld that view. Furthermore, citizens have a right to choose their presidents, not state legislatures. Hope that helps you understand things better... As you always do, you look for some way to rationalize the facts, trying to find something, anything, you can dispute and twist, in an effort to prove you're right, instead of using your common sense to understand the point of the post you're reading.

Bingo. That's the KEY issue. You can't use the 14th amendment if there is no charge, let alone a conviction. The Supreme Court did its job and made the right decision. It's the PEOPLE'S choice. The minute the government gets to decide who leads us, our country and its foundational basis is gone forever. The WORST insurrection we could ever have is one in which the government takes full control over our choice.
