children,accident, seat belt

my husband is a firefighter and today he went to a call about a wreck. Well when he go there he found out that a little five year old boy had been sitting in his mama's lap when the guy driving the truck that he was in got t-boned. The guy driving didn't even know the lady's last name and he told the cops that he was not going to take the lady to the hospital to see her son. What made me mad was he was net even buckled up.They had to drive the little boy to savannah Ga. They don't think that he will make it he landed on his face. Do u think that the mama and the guy that was driving should get time or just one of them?

who ever was at fault should pay dearly. The mother-It would depend on the circumstances and the reason that the child was in her lap and not in a car seat.

i think that mother should have at least buckled the little boy up. i can understand not having the booster seat b/c of the fact that he was 5 and old enough not to have to have one. i think that they should both be charged.

It is just as much his fault as hers. He should have never moved until the kid was buckled up in the backseat. If she didn't know the man and didn't want to put her son in harm she could have sat in back with him or just not rode with the man. I hope the little boy is ok.

i agree with everything that u said but it was a truck with just one seat. so yea they could have put him in the middle. thank you for responding.

OK in the middle unless it was a king cab... but all the same he should have been buckled

That is a hard one but the child should have been in a child seat but I guess you could not put one in a pickup. Probably they should both be cited.

my husband has a truck just like the one that was in the accident and trust me it would fit a car seat but the boy was big enough for just a booster seat. we have two little boys one is five and the other one is three and he has put both of their car seats in his truck and still had pleant of room for himself.

Geez, you couldnt have found a little harder question? I think that I dont know. I think the man and woman are both negligent, one as the driver and one as the mother. I think this is one for the jury.
