Road Rage.. children involved.... Do you think i have a case?

March 25th 2008 me(who was pregnant), my fiance and my 2 kids and my fiance's brother were on our way back from fort lauderdale airport becasue we had just picked up my fiances brother. He had come down because i was going to give birth to the first girl on there side of the family. Very exciting moment for that side of the family!! We were on our way down the road when this white pick up came up behind us and was practically almost riding our bumper, due to traffic we really couldnt do much as far as speeding up or anything so when he finally had a chance to jump around us he did and as he was passing he gave us the finger and then jumped infront of us and gave the finger somemore. so of course when we passed him we gave him the finger back. because our oldest son noticed that he gave the finger and said "daddy that man gave you the bird" well when he got up to the first stop light we happened to be side by side and my fiance rolled down the window and asked him what his f'n problem was and told him that we had kids in the car. his response was "i dont give a F*** about your kids","ill put a F'n cap in your A**""you F'n wet back" (which is slander to mexicans) so i rolled my window when he said that so he could see that there were kids back there. Well going down the road some more everytime we would get near him he would roll his window down and yell more stuff at us and kept telling us to pull over he would kick our(the guys) a**'s. well one time he went to pull over so we went up a little ways and pulled over well he then pulled back out onto the road, so we pulled back out thinking ok maybe he changed his mind and he would leave us alone.nope! Going down the road some more i guess he slowed down so we could catch up to him but all the sudden i hear "omg no he didnt" and i said "what" and then i see my fiance and his brother picking up there phone and dial 911. i asked them what happened and they said "he just pulled out a gun" I automatically started getting really upset and writing his tag number down incase i needed it. well we finally got the cops to stop him in our town where we live because that was originally where we were headed till he pulled the gun. they pulled him over so we went up the street and pulled into the parking lot and waited for the cops to come over to us and tell us whatever they had to tell us. When the cop came over to our vehicle he said that "this is a case of a bad cop making a good cop look bad" I was really mad now because my question to the cop was "why did he pull out his gun when he could have easily flashed his badge" The cop asked my fiance at first if he wanted to file a report and at first he said no. Then he asked me and i said yes, There was no way i was letting this man get away with this, it would have been one thing if my kids werent in the car and we were out looking for trouble but we werent. we were all in good moods, it was my fiances brothers first trip to florida and our area and we were getting ready to give birth to a little girl the very next day so it was an exciting time. The cop was off duty and admitted to the other officers that he pulled the gun out. We got a letter from the states attorney and they are charging him with 3 counts of assult and one count of exhibition of a deadly weapon. Depending on how that goes and what happens i am debating weather or not i can take him to civil court because i think he should have been charged with child endagerment and what ever else i can get him with. I am doing it not for myself but for my kids mainly my 7 year old because he is old enough to know what is going on. I havent really brought up to him what is going on BUT im sure he was effected by it. Cops are supposed to protect.. now that isnt the image he has of cops anymore all because of one bad cop. I think he should lose his badge for good. be fired if he wasnt already, and never be allowed to own a fire arm ever again. Our court date is set for July 7th 2008 so we will see how it goes. Me and my mom were talking about all the things that could have happened that day and how dangerous of a situation this was. What are your feelings on this? do you think i have a civil case against this man after this case i have now with the state against him?
