You Have Five Days to Get Out

That is what my landlord told me yesterday. I was just as surprised as anybody else reading this discussion. : ) Long story short, she told me I was not paying my rent, and hadn't for two months. Well, some of you may remember my discussion about how housing is paying for all my rent now because I gave them all my medical bills, and I qualified not to pay rent. So it turns out they didn't pay all of my rent last month, and that is why my landlord thought I wasn't paying it, because they had come up short on my account. She has a call into the housing department, as do I, but she knows now it isn't my fault. I'm glad we got it worked out, but she could have avoided this if she had called me the day she thought my rent was late. I could have cleared this up easily. No harm, no foul. But for a moment I was truly concerned because it was so out of the blue. What was the last bit of news, or event that caught you off guard, and left you with a mess to sort out? I hope housing settles it soon because on my account it still says I owe the money, even though I don't. My landlord knows it is housing's fault, but I want everything taken care of. What about you guys? Any out of the blue, where did that come from moments? : )

Oh, man! I would have been freaking out if that happened to me. I hope that it all gets straightened out for you right away. You are right though, she should have called you about it first instead of telling you to get out like that.

Lilybug, hopefully all works out for you. But speaking as a landlord, just for future information on your behalf, you should make sure that YOU know that your rent has been paid. Usually the TENANT is the first to know that they are late and have not paid. And as with any debt owed, it is your responsibility whether or not you receive notice. Creditors and landlords send a late notice "as a courtesy". Lucky for you she is willing to work with you to get it sorted out, because contractually she has the right to proceed with eviction and contractually you are in breach of contract. 5 days is like a minute in government time so I pray that they will get it worked out in a timely manner.

Well, my rent was paid, and I had no further obligation. I have proof my rent was paid, I knew it was paid, and the landlord was the one in the wrong. Has she paid attention she would have seen that the person not paying was housing. It was not my responsibility to check anything since I was doing everything I was supposed to do. This TENANT did the right thing, while the LANDLORD should have checked her facts. It all could have been avoided because I had the letters to prove my case, and she could have got her money from housing right away.

Oh, and she didn't have the right to evict me. It was not my part of the rent missing. The letters I had would have prevented me from being evicted. Believe me, I know my rights. And I went over this with her. She apologized because SHE was wrong.

I had co-signed for my daughter's car she was not very good about making the payment so to keep my credit good I had made a total of $8,000.00 payment for her over the 2 years she had the car. Then during the night last February she parked the car in my driveway and left the keys in it! I was stuck with $12,600.00 still owing on it. So now my credit is ruined and have a repossession against me and am still paying off the balance. Lesson learned NEVER co-sign for anyone!

LOL---well I don't think I have to tell you of lovely gov't. screw ups and red tape I've gone through....like I had last year when SSI cut my benefits off out of the blue and all the shat I had to do to get them back...like QUICK. I had the same problem..not with rent, but last year when I was going through all that, I was able to get Public Assistance to help pay for one month's electric and gas bill (only a month...gee)...thing was I applied for it in May but Public Assistance didn't come through until July....so to the electric and gas companies I was having the same problems and it had looked like I wasn't paying into those bills...nearly got my electric and gas cut off due to the delays with Public Assistance. Bet you nearly had a heart attack when your landlord told you that, but glad you're getting it straightened out...why is it any govt agency wants their money if you owe them and want it yesterday..but if they are owing you money they take their own sweet time about it.

They know we need them, and they don't need us. I knew before I was on disability that the system was screwed up, of that I had no doubt. But until I was IN the system, I had no actual clue how bad it could be. I'm grateful, let no one ever doubt that, but the stress just working things out sets people's health back.

It wasn't long ago that I got news like that and I have a hard time functioning when something comes up....throws me for a loop...THen I can't really concentrate on anything until the matter is cleared up!

Hi AmbiePam, Even with this mix up I think your Landlady was very harsh to initally tell you you only have five days to get out anyway, even someone behind on their rent gets more notice than that. I am really pleased that you and her have managed to resolve the issue though but it would have been a lot better like you say if she had made contact immediately so you could have dealt with it then rather than wait until now. I had a call from my Landlord today in fact as I usually pay my rent on a Thursday each week but as I haven't been well I went yesterday afternoon and paid last week and this week together. It was showing on their account yet but when I explained they said that was fine but as it was so unusal thought they would call to find out if everything was okay, so they have got this weeks in advance really. I'm sorry to hear that you have to go through this. I have been through alot of things like this in my life. We had to fight to keep our home about 2 years ago because the bank said they didn't get my payment. I always paid early or on time. They finally realised they did have my check, but they had sent me a foreclosure notice first. That was rediculous because we were never late or missed any payments.

i think that the strangest thing that happened to me fairly recently was after i returned back to work in october after my maternity leave. i had prepaid for my benefits while i was on leave and when i returned to work, they said that they would reimburse me for whatever was paid before hand since i had returned early that what was scheduled. because i switched from full- to part-time, it apparently took my retarded human resources manager almost two months to change it in the computer. when she finally got it right, they had already discontinued my benefits retroactively. since this was unknown to me, we went to doctor's appointments as usual. we got a bunch of bills in the mail, saying that it had been denied. we got everything paid, but i was totally bewildered!

That happened to my mom a long time ago. It took a year before my parents got reimbursed. I don't envy the headache you must have had dealing with that.

I'm glad it all got cleared up. I had a issue alittle bit similar to that one time where I was supposedly going to be living in a friend of my boyfriends house, he later then said that he never said that I could live there whne I had already given notice at my old place. I was lucky I was able to get my apartment back.

Actually today I opened the mail and found out I have a bank loan that is now under review for adjustment to the interest rate in view of the 'uncertain' economy or some such gobblygook. Loan? I have a loan? I don't have a loan. Certainly not one for over $25,000.00! So I'm thinking - wrong person. I check the address. Right house, wrong spouse! Seems the hubs took out a loan during our separation with a bank I have an account with. His credit sucks, mine doesn't, so he presented himself as my spouse (understandable) and they gave him a car loan mostly based on MY good standing with them, as he doesn't and never has had an account there. I knew the car was financed. I had NO idea it was financed on my credit! No wonder the credit card company upped my limit! So hubs is going to have a LOT of explaining to do when he gets home tonight! You betcha!

I think it was a bit harsh of your landlord to suddenly kick you out with so little notice without hearing your reason for not paying first. Some people have really good reasons for not paying on time and if it is only once or twice then I see no problem. I have a feeling this may cause future disruption. Glad everything is fine at the moment and hopefully the housing get their finger out of their pocket.

I was mostly surprised because I knew I had been paying my rent, and then when I received the notice that my medical bills were large enough so that the housing department would pay my entire rent, I even went to far as to tell the office this, just to make sure they knew too (even though housing had also sent them a letter). So even after that, they still showed up, wondering why my "rent" wasn't paid. They were reluctantly sorry they had made a mistake and that is was the fault of the housing authority. I say reluctantly sorry because you know they hate having to admit mistakes! : )

Yeah, I would think that your landlord would notify you ahead of time when they haven't been receiving your rent and then when they notice that you haven't been paying for 2 months decide to throw you out. That is just crazy, they didn't even notify you and aren't they suppose to give you a certain time to be out of the place. I know here they have to know you 30 days before, it may be different with you. But still, it's good that you informed her of what was going on.

yeah it is tough as though it is housing's fault, I can see how the responsibility may fall onto you as the renter...But I am not a landlord myself but I would say that ultimately if the housing does not pay for it I do not see how the landlord could still look to you to collect money....It is good that your landlord is so reasonable with the fact that housing is late on its paying her, but she could have continued with her eviction with you. You have a great landlord, be so thankful for that.

No, legally she couldn't have continued the eviction. Not with the letter I had to prove what housing did and did not owe.

i have an out of the blue moment regarding rent too. though its from a number of years ago! my boyfriend (at the time) had been renting this cute little 1 bedroom apartment that was on the property of the landlord...a bit behind his house actually. i loved the place, pretty spacious for a 1 bedroom. it was $625 per month with all utilities included. we had been there for about 5 months when one afternoon the landlord knocked on the door when my boyfriend was at work. (i was home cause id been helping to take care of his very ill grandmother so didnt have a day to day paying job) the landlord said he need 2 months worth of rent in a week or he would start the eviction process!! i was dumbfounded! i remember standing there staring at him with my mouth hanging open for at least a minute! the rent was always due on the 5th off the month and every month i had been asking my boyfriend if he had paid it..he always said yes! i told the landlord i didnt know what he was talking about the bf said it was paid! he just said "you need to talk to him then cause it hasnt been for 2 months now!" and walked away! after freaking out and freaking out some more, my bf finally got home from "work" and a HUGE argument..it turns out that he had been fired almost 3 months before and had been lying to me about paying rent AND about going to work everyday! which of course freaked me out even more! to say the least the very last straw was when i found out what he had been doing for months.....hanging out with his friends!!! he hadnt even been looking for work! IF he had told me what happened i could have been looking for paying work! to cut it short (lol) we ended up being evicted..which was embarassing...we broke up very soon afterwards... lol hows that for out of the blue?!

When I was on Medicaid (for pregnant women) they cancelled my coverage by mistake over a misunderstanding from something I'd said in a voice mail. She wanted me to go on food stamps, and I didn't want them. So she canceled everything as if I didn't need coverage of any kind anymore. And I had to call the woman at the office and ask her where the heck I was supposed to have my baby. They reinstated coverage ASAP to pay for doctor/hospital bills. I didn't have any money at the time due to job loss. So that was fortunate. Long story short. Dealing with the state government and having them pay for my baby's bills was a big old pain in the rear, so next time I'm paying delivery charges out of my own pocket. I am not getting stuck in those low rent clinics again.

I don't know what is like to have to get government help for being pregnant, but I imagine it is more worrisome because it isn't just you getting the care, it is your baby. I could never afford any of my medical bills without Medicaid, so I'm grateful, but I see so many things that could be fixed, and I don't think with a lot of fuss or overhaul. Did you at least get WIC without much of a problem?

The last bit of news that I recieved that shocked me sadly was the my grandfather pssed away. It was very sudden and he was only 59 so it was very shocking. :-(

I know how you feel. That's horrible!!! Once, last year as a matter of fact, my apartment complex was renting out the apartment under mine and so when they faxed over the paperwork to DTE for new tenency they had the apartment numbers wrong and so DTE Energy changed my bill to someone else originally and when they thought they fixed it, they changed the name of the guy to his own apartment but didn't tell DTE that I was still there. Long story short, my apartment went back into the complexes name and I realized that I hadn't gotten a bill in a couple of months and called and changed it back into my name. Well a week later, I received an eviction notice saying that I had violated the lease by not having my utilities in my name. I was so pissed!!! Livid!!! I called the corporate office and all they had to say was "oh, our bad!)

So sorry to hear that you had to endure that kind of worry. I know how you feel, I have been going through a terrible time since February 10th 2008. I had been off sick with acute anaemia, from my job as a technical support person working for an English company here in Spain. The owner is a right ....... (expletive). The day I returned he told me he was making me redundant. I signed the papers, which were in Spanish, took them to my bank to claim on the car loan insurance and was promptly told that the paper said I had been dismissed for not fulfilling the terms on my contract. I had worked for this company for 16 months. So I was advised to take him to court for unfair dismissal. Im still waiting for the case, during which time I am not allowed to work on contract, nor claim any benefit. I have borrowed from each and every family member and friend and have just about run out of resources, they're all broke now too. So, my case is in court on September 2nd, and I still dont know if I will win. Bit of a bummer really, Ive only got three weeks to go and Im absolutely starving.
