Exposing corruption in the court system...

As many of my friends know I've been going through a really difficult time with the court system, back on February 6th I learned that the decree with regard to the court hearing of November 23 of 2008 was made on December 1st of 2008. I had patiently been waiting to hear the ruling of the judge on that court hearing. Now another hearing is requested to address the financial issues of that previous ruling. That is how I now know about the previous ruling of December 1st. All of this is about declaring my grandmother incapacitated and in order to do that they prevented her from having a say in the November 23 proceeding. This is a clear case of elder abuse. The judge had in the past been a prosecutor and I was convicted by him something that I have previously shared here on MyLot. The judge has a duty to make sure there is not a conflict of interest. From Wikipedia - (Two sections of Title 28 of the United States Code (the Judicial Code) provide standards for judicial disqualification or recusal. Section 455, captioned "Disqualification of justice, judge, or magistrate judge," provides that a federal judge "shall disqualify himself in any proceeding in which his impartiality might reasonably be questioned.") Yep, Until it happened to me, I had no idea just how bad it was... My mother ended up in a situation once as a result of my keen observations she had hired a bad contractor to build a new garage and here I was the good son watching the project and I noted that something didn't look right. Mom had a friend who worked as an excavator come over and check out the work of this general contractor and found the block work was one and a half feet out of square the footer was narrow and the structure was not squared up to begin with. So that ended up in a court battle where the judge sided with the contractor and it cost my mother and step father a small fortune for the bad workmanship and court proceedings. But I'm the bad son obviously needing to be punished when I get into a bad court process. So I get railroaded and mom is one unit with the lead being the lying detective and my sister, my former wife, and step mother have their fingers into strangling me and cutting me out of communication and access to my grandmother and children. I've heard of so many complaints about how the court system works, and here is a chance to turn the tables, as I see this as the only way we can make changes to expose the corruption. I hope the right thing is going to happen here... I hate the feeling of being all alone. Thanks to my internet friends I know I am not alone in this... I hope no one ever has to go through this ever again. Isn't it time we start doing the right thing from the bench? Judges are certainly the cornerstone of a civilized society, As does the judge so does the community... If there is corruption at the bench there is corruption everywhere... I wonder what is wrong with our world? I wonder if it could be made even a little better? I am doing my part. I'll keep posting as long as I am aloud to...

Oh' My shouting comments, aloud should have been allowed, as I must have been in too much of a rush, my fingers crossed and I flashed a word that I had no intention of using but a word it was one of many and the other that sounds the same having the proper meaning is now brought forth for your consideration... Where are the spelling police, the grammar police? I think I have a violation here... Bring the hoops over the the hole loop that I've just jumped through... Oh' silly me? Hi Gary! I really don't know anything about your court/justice system but I do believe that there is something wrong with the proceedings concerning your grandmother. All I know is that to prove someone incapacitated, they should not have prevented her from having a say on her behalf. Hi TheGreatWhiteBuffalo, That case years ago has nothing to do with this case and it should not make a difference to this case, its such a shame you don't have a different judge for this case. Tamara

What is the chance that this judge has a bias against me? In that event the case many years ago would explain why all of my allegations were not given the time of day when I tried to expose the lies and conflict of interest in lawyer who was supposed to be representing my grandmother. Why didn't he want her to speak upon her own behalf. 1.) This particular lawyer happened to do a little work for me first in my case with the issues in the relationship with my mother and my wife and the lies that had me involuntarily committed. 2.) The lawyer never set up or had any consultations with me. 3.) The lawyer never set up an evaluation of my grandmother's mental health. 4.) There was never any evaluation of how each family member interacted with my grandmother and who would best be suited to help maintain her mental health encouraging her in our memories that we share with love. 5.) The lawyer was not working for my grandmother but he was working for my mother and my sister in helping them cut me out of association with my grandmother so that my sister could take over my role from a distance... My sister is beting that she can win the farm by helping our step mother... So we have one judge with a conflict of interest and we have a lawyer with a conflict of interest, and by the way what did I say in the last court hearing? Now what about the lawyer for the petitioner? Is he above the law? What is significant about this case and related to the case you might find in Justia.???? (Hint, Hint) Rock my world NPR and WYSP...

Sounds like you need to let the lawyer know you will have to call the bar association and see how these types of court cases are handled. You want to say it like that so that you look innocent saying bar association. You want to call the bar association just to let them know what is going on. If they look into it, there might be a couple of unemployed lawyers. The one that is prosecuting the case against your grandmother which should be the lawyer for your mom and sis isn't going to try to help your grandmother. He or she also won't be too interested in what the other lawyer does.

Hi Great White: I'm sorry to hear that your legal woes continue to thrive in your life, thereby keeping you from seeking peace, and happiness with your loved ones. I would like very much to be in the court room by your side showing support for you. Just to walk into a courthouse can reak havock on your nerves, and sitting in court waiting for someone to decide what happens with your life is gut wretching. I live in Delaware County, and I have a doctor appointment that morning, or I would be there with you. Since I can't do that, the least I can do is be hear to listen, and help in any other way I can. Isn't there something that can be done legally?

even we had some stint with the court and i can say it is not a favourable experience.....the court proceedings are often influenced by various factorslike those who twist the truth and everybody beleives them.i think it is no longer a place where one can tell the truth and it is accepted.

Sounds like a conflict of interest to me. Not to mention there being something wrong about not allowing your grandmother to participate. Not sure I'm surprised though. The things I hear from my cousin regarding her custody case would scare anybody who is considering taking anything to court (or being taken as the case may be).

I hope there is a better plan that I can come up with... Maybe a little public moral and ethical pressure upon the system? How many times have I been in the court room setting in the past 7 years? Starting June 22, 2001? I know there are a couple of more coming up also... They kind of grow on us as time goes by... More and more gets added to the mix...

What a horrible situation. If your grandmother has an attorney which she should, you need to voice your concern. If not go to the prosecuting attorney in your grandmother's town and see what can be done. You will probably be looked at as if you have three heads depending on who is trying to have your grandmother declared unfit and why. Good luck to your grandmother and you.

My Grandmothers attorney actually turned out to be working for my mother and sister... That is his conflict of interest. The Bar association is useless, I tried to contact them about another issue with another attorney and nothing was done... I know better than to call upon that agency, I also had some issues with lawyer referral services and the Judicial Review board... No help is the theme of the government of the past 7 years.
