Let's say that tomorrow Obama has a surprise press conference and tell the world that it is true that he was born in Kenya, then what?

Impeachment would be in order and I think, as much as I don't care for Congress right now, they would begin the process. If they didn't, all h*ll would break loose in this country. But this is so hypothetical it's hard to play... Obama will never make such an announcement, even if it was true. He's enjoying the power too much... And he'll fight like h*ll to keep that power.

it is enormously unlikely, but if it happens a lot of people will need a new hobby. expect to see millions of new konspiracies popping up all over the place. i'm going to get odds from a bookies about the chances of this ever actually happening.

Well yeah the odd of this happening is one in a million if not a billion, but if some people are going to send their whole time here on MyLot trying to make the case that Obama is ineligible then they also need to state how they are going to resolve the issue.

He has to resign from office move out of the white house and he can go to jail for lying on a fedral document.........Frauding the american peple and abunch of other charges unless Joe Biden would be dumb enough to pardon him....If that were to happen the American people would really be mad they were lied to....

Biden wouldn't be able to pardon him unless he was convicted and, I agree, the possibility of federal charges being filed would be great.

Well, he would have to step down obviously. If he refused,it would then be the responsability of the military or at least federal law enforcement to arrest him for treason. If he steps down, he at most may face impeachment. If he doesn't step down after admiting this and refuses to surrender power, he is committing an act of treasonous insurcetion againt the Umited States, trying to illegaly sieze power...one could even go as far as to call it a coup' if he refuses.

WEll technicly if he wasn't qualified, he didnt really win and isnt actually the commander in chief, he illegaly seized power and in doing so, commited an act of treason, even a bloodless coup I cant claim one hundred percent accuarcy in this, the legalities may turn out more complicated then that although in my opinion it shoudln't be. technicly there is no provision in the constitution for removing a president other than impeachment, but this is an etiorely different set of circumstances. This is not a matter of a legitimate president being impeached and removed for a transgression of some sort, this is an ilegitimate leader sizing power, a man who isn't genuinely president. Let me state for the record I do not believe this to be the case. I believe Barak Obama was legitimatly qualified to be president. Unless someone puts up some compelling evidence to the contrary, this is what I will stick to. but it's fun to think these scenarios through if for nothing more than a good intellectual excercise. It gets people thinking about the unthinkable, because it is only unthinkable until it happens.

xfahctor, this is definitely an out of the ordinary situation but it seems to me that the authority to remove a president has to come from the legislature following the impeachment process. The U.S. Attorney's Office could charge him with treason and even arrest him but he would still, technically, be the president. Since he is also the Commander In Chief of the military, no one has the authority to order his removal from office by military force. This is why we have the impeachment process...to avoid coup like situations. At least that's my understanding of it.

Hi, gewcew23. I guess, I will be like okay, continue on as President. If he was not born in Kenya, then that means that he has lied about where he was born. It would be a shock, but life goes on, I guess. For me. But maybe not for others that looked up to him.

I've read the comments you've received so far, gewcew. I do agree that the best thing for him to do would be to resign, which would make Joe Biden the president. If he refused then the impeachment process would be initiated by the House. Even though the Democrats are in the majority, they cannot attempt to block impeachment under the circumstances you have outlined, as they would be subject to ethics violations or legislative misconduct for trying. So, it would take a little time but Obama would be impeached.

Why would they be subject to ethics violation, and who would charge them with the ethics violation? The Republican, they are the minority party and cannot force the Democrats to do anything. Ethics violations are voted on, who is the majority, the Democrats. So Obama would only be impeached if the GOP retook the House in November, and got a 2/3 majority in the Senate which is mathematically impossible.

They would be subject to ethics or misconduct violations because they are required to adhere to a code of conduct that does not include circumventing the Constitution or the legislative process. If Obama confessed that he was not eligible to run for president in the first place then he *is* in office illegally...no one could dispute that regardless of how much they liked the man. Both the House and Senate police themselves and, no, I don't know much about this but I do know that it's not the lawlessness of the Wild West on Capitol Hill. Unless someone came up with something out of left field that the Democrats could get behind without looking like they were sanctioning a fraud, their only options would be to support the impeachment process or stay out of it entirely when the time came to vote. The American people would also be watching and I can pretty much guarantee that any Democrat who thumbed his/her nose at the legislative process in this situation would not be re-elected. I really don't believe that the entire Democrat party is unethical or stupid. BTW, I do know that not all ethics violations are voted on. Expulsion is but that's the most serious consequence.

That's not how the ethics rules work. There is no legal requirement regarding how a Senator or Representative votes on articles of impeachment or conviction. There would, however, be intense political pressure on all congress critters to impeach. So it's a good thing that this scenario simply isn't going to happen, because President Obama was born in Hawaii, as documented by his birth certificate and reported in the local newspapers when the event occurred.

He'd be ousted from office, and any criminal charges brought against him would be pardoned by his former VP. What I'd like to know, is, if legislation signed by a president who was never qualified to be president in the first place, would that invalidate it?

Technically yes, that would invalidate it, as he was never a legitimate president and never had the authority to sign bills. Now I'm not sure what the process would be after that if Biden would just be able to resign them and have it all be as it is or if there would be some other process to go through.

Don't know. His mother was an American citizen when he was born and she did not marry his father so I think that even if he was born in Kenya then it'll still all be legit. One thing for sure is that a whole lot of people will have to come up with something new and improved to speculate and dramatize on.

That'll never happen. After all, weren't we told repeatedly that this is guy is the smartest president we've ever had, lol? If it's found that he is inelgible to be president, the Pentagon will remove him, and a civilian at the top of the food chain at the Pentagon will run the country until elections are held. Biden and the Democrats will have federal charges against them for election fraud, and they will be escorted from the premises, and possibly prosecuted later on. There's a lot to lose if the truth is ever found out, IF this is true. Nttice I said if this is true.

Well, that is an interesting twist but not according to the Constitution. The Pentagon has no authority to act on it's own and definitely is not given the authority to appoint anyone to run the country for any amount of time. Only the legislative branch of the government, specifically both houses of congress, can remove a president from office and they can do it very effectively. The charge would be election fraud...possibly treason but election fraud and the not being a natural born citizen part would do the trick. The fact that Biden was Obama's running mate does not automatically make him or anyone else complicit in the crime. That would have to be determined through hearings of the Judicial Committee in the House of Representatives with individual criminal charges filed based on the outcome. In the meantime, Biden would become the president because the first order of business would be to impeach Obama. Once Biden was president he would nominate someone to replace him as Vice President. If he did participate in election fraud and was impeached also, that person would become the president and he would nominate someone to become Vice President. It's actually a very orderly process.
