I am not just saying this, I am very close to a Breakdown and I will be going to my Doctor today as I am going to need all the Strength I can get The Police came round to me last Night to take my Statement, they are very nice This was 8pm............at 9.45pm ( The Owner was still in Custody, as she had been arrested at 7pm) The Police came back to me, asking me if my Witness had phoned me yet, well Jean was on the Phone at the time, so the Police Woman spoke to her and then asked if she could go round and get a Statement of her Before she left she said to me........Gaby I need to take a Statement on how many times you kicked the Dog, ...... I told her I more pushed the Dog the Dog with my leg, injured leg, then kick, as I had no energy and was trying to breath, I told her about my Illnesses, I then asked her if that will against me, she said to me I really don't know Gaby, but I am doing my best here to get this sorted, please do not worry So now the Owner is trying to get me charged for 'kicking' her Dog I broke into tears and told the Police Woman, I am the one who is in Pain here who is going to be scarred for Life, who will not wear shorts or anything above the calf again, I am the one who is the Victim, her Dog went for mine while I was holding my Dog, her Dog shook me like a Rag Doll, her Dog has now been on the Loose the second time and caused havoc She was trying to calm me down Jean rang me later, after the Police had left her She asked me if I was ok as I was still crying, so I told her how this is turning, she was shocked, she then told me that she was also asked how many times I kicked the Dog, Jean told them it was not so much Kicking it was more pushing him away with my foot, she was asked if the Dog had bitten me before or after me kicking him, so Jean told them the Dog had bitten me before and it was with the injured leg that I was pushing him away, that I was trying to breathe to but would not give up trying to rescue Gissi, she was also asked how many times I 'kicked' the Dog, so Jean again made it plain that I pushed him no more then twice with my Foot, Well anyway, I will never do the right thing again, as usual doing the right thing back fired on me, the Victim is being turned into a Hooligan, I was trying to avoid Child being attacked by this Dog, I went for the Option of Neighbourly Resolution not charge, and because she was told she had to muzzle her Dog and keep him under Control she went for the option of being arrested and of the chance of her Dog being put down, now she is trying to turn it that she is the Victim because I 'kicked' her dog, even though I kept to my word and took the Option of the Dog not being put down If this is how she wants to play fine by me, there are Photos of my leg, there is a Hospital record and if this is going to head that way I will sue, all I wanted was to make sure that a dangerous Dog was put under control and now this I will state though, the Police are doing their best, when Jean told the Police Woman last Night 'Gaby did not want all this, she just wanted to make sure that no one else got hurt by this dog' She said 'Yes I know' I can not believe this Woman, if not so much seeing the Injury on me, which will scar me for life, why does she not think about wht this Dog could do to a Child?????????????? The Police took a Picture of my Leg which has turned out better then the one I took so I will attach it Thank you to all of you for all your support in this I love you all

You know sweetie. Here it won't be tolerated. The dog would be put down and the owner will pay a very hefty fine as well as any medical bills, the victim have. I cannot think that this stupid women will go so far as to try and pin this on you. She has made the biggest mistake ever. She is going to loose this one, don't you worry. Hope she will move to another freaking state after this. Luck. TATA.

This woman is such b1tch! I am in disbelief over her attitude and the fact that she is prepared to have the dog put down if the judge decides to; I hope part of the charge against her is that she never owns a pet again! I know it’s easy for me to say but do try not to stress too much and take care of yourself. It is a good idea to see the doctor. I am sorry this has happened Gabs...Here’s hoping it will all be resolved as harmoniously as possible. Take care my friend...

Oh my goodness, like I said before that women is off her rocker. You don't have nothing to worry about as to getting in trouble for "kicking" her dog. Whether you pushed the dog, kicked the dog or even beat the dog with a ball bat when he had your leg in his mouth. You have every right to defend yourself. That dog is a vicious dog, he was attacking and he was loose. That women is in trouble. I just hope you heal fast and it doesn't get infected, dog bites/puncture wounds can be very bad. Take care, lots of hugs coming your way.

Gabs you did the RIGHT thing. Do not try to second guess yourself. It seems to be coming down to semantics between kicked and pushed! IMO you were defending yourself by trying to PUSH the dog off your leg. This could not be construed as a kick because IMO for a kick you would need to have full control and power of your leg without a vicious dog latched on to it. I think your friend Jean's statement will do a lot to confirm it was not a kick aimed at the dog but a self defending push.

Don't let a moron like her make u sick, gabs, she's not worth it. Hang in there sunshine & hopefully it will be settled soon. I think she must have a mental problem to be acting like she is. Maybe they need to put her down w/the dog, lol. U just take care of that leg. Here they would have penned the dog up for a couple of weeks to make sure he wasn't rabid or whatever. Hope they have done this. I'm soo glad u have a witness that is sticking by u. hugs, jo

Gabs, I have read all your posts and some of the other concerned members. This whole incident strikes me as nasty. You have to get hold of yourself and first get to the dr and make sure that leg is ok . You might be scarred on your leg for life but your heart was in the right place when you defended yourself, your dog and any other future attacks be it a child or another dog or a person. It does strike a weird chord that this owner didn't take you up on your first offer and thereby save herself and her dog............. However, she has to be a nasty person and if they do put that dog down your actions could have saved anyone and that is to be proud of. I am sure in court when the judge sees your leg he will give you the right decision. I know this has been a horrible ordeal and we all here at mylot pray for you and Gissi both. Hang in there kiddo. hugs, quita

She's fighting a losing effort. She would not win if she pressed charges against you. No way would someone believe her over the evidence that you have. I mean I would be feeling overwhelmed, don't get me wrong. I think you've held yourself together amazingly well. That woman is unbeliavable. And I am sorry you are having to deal with this stuff, especially with your health. I just can't help but think common sense will prevail, and that woman will get what she deserves. I just hope things with her dog work out for the best for the dog and other people. I don't care so much about the owner.

Hi gabs, I cannot believe this is happening! You tried to do what was right and now this. There are some mixed up people in the world but I feel certain that everything will wok out right. Please relax as it's not good for you to get upset. I know that's easy for me to say as I'm not the one involved in this but it just isn't fair that you should be going through this. It was only right that you report the dog and no one could have suspected that the dog's owner would act like this. Blessings.

I know what she is doing gabs. She's trying to make it sound like you kicked the dog first, therefore the dog attacked you and gissi. That's what she is doing. You stick to the truth because this dog attacked gissi first, so any dog owner would have done what you did, and the dog is lucky you didn't have a bat in your hand. You did not do this for the simple reason that you do not like the dog. The dog attacked YOUR dog, who is very tiny, and you were only protecting Gissi, a very normal reaction for anyone. The courts will see this, that's why they want a witness. You had every right to do what you did, but she's making it look like you started the whole episode by kicking the dog first. She's a nutcase. Once the courts hear that this dog had gissi by the neck, the tables will turn on the woman, and until they hear the whole story, they have no idea what went on. And, this is the second attack. Try not to worry too much about this, if that's possible, as the truth will be told. And it shouldn't even matter whether you pushed the dog or kicked it, you were only protecting yourself and your own puppy which is what ANYONE would have done, and I'm sure you would do it over again...so would I. The nutcase is just re-arranging the story. This is all on your side and you will prevail in the situation....the courts will not look at it any other way I'm sure. Please try not to worry too much, get some rest, and stay off your leg so it can heal properly.

I'm so sorry all this had to happen to you, gabs, but you know, you're doing the right thing. You just need to relax right now. Things happen, bad things happen, and we just need to keep holding our head up and trudge though. The police are obviously on your side. The evidence is on your side. The witnesses to this are on your side. You have nothing to worry about. The police know that she's full of shiit. They had to ask you about kicking her dog because she was trying to accuse you of starting all this. It was simply part of their job. But, they know you are the innocent victim in this so don't worry. Just the fact that this is the second time her dog has gotten loose is enough to show that she's to blame in this. The records of her dog being picked up earlier to this incident will prove that she is an irresponsible pet owner. Everything involved in this incident is on your side, Gaby. It's obvious that this woman is trying to turn it around but the police aren't fools. They've dealt with her kind before. The judges have, too. You don't have a thing to worry about except getting better. You need to calm down and know that the truth will come out. Just try to think of everything that happens now as being one step closer to getting this behind you. As for the scars, the physical scars, don't worry about them. If I worried about all my scars, I'd be covered from head to foot but I don't worry about them. Don't worry about what other people think. Your scars won't be that bad, actually. I've seen a LOT worse! I wouldn't think twice about the scars you'll have on your leg. I probably wouldn't even think once about them. You may have a fear of dogs you don't know for awhile now but that's perfectly normal. Maybe, from this point on, you can take Gissi out after meeting up with a friend and the two of you walk to the park together. Try not to let this change the way you live. You need to do as many routine things as you can now to get yourself back to normal. Now, try to get your mind off this as much as you can. It won't do any good to dwell on it when you don't have to. Try to do things that you really enjoy doing, even if it's getting more involved here in myLot on different discussions. Remember, bad things happen to good people all the time. It's not what happens to us that matters in this world, it's how we react to them. Hold your head up and know that you're the winner in all this, despite the scars. You're going to come out on top of this and stronger for it.

I am so sorry to hear that you had to go through this! *HUGS* I do hope that you are doing better now both physically and emotionally. This has been quite a traumatic experience for you, and it sounds like you were just trying to make sure that everybody was safe including the dog that bit you. How big as this dog, because from the marks on your leg it looks like it was a pretty big dog. Even a small dog can seriously hurt a child, but a large dog can kill a child even before anybody can do anything about it. I am so sorry that this person is trying to turn this around and make it seem like your fault, especially when you were just trying to keep everyone safe.

I think I see what has happened here. The woman came to you all sweetness and light in an effort to placate you and calm you down. She would have agreed to anything you asked. If you had told her you think the dog should be put down, she would have done that. All you said was you wanted the dog muzzled and under control at all times. She happily agreed and thought it was all over. She had calmed you down and sucked up to you and she had no intention of doing anything. When the police came she became p!ssed off. You weren't supposed to go to the cops. You are the worst woman she feels, in the world for going to the cops and she has behaved in a very odd way and in doing so made her case to the police and showing herself to them in a very negative way. This is very strange on the part of this deceitful woman who obviously does not care for her dog...it escapes and it bites people...those two things alone tells me something is wrong. Keep your chin up my friend, you have absolutely done nothing wrong.

Any moron could see from the angle of the wound (I looked closely at your pix, and it turned out wonderfully!) that you didn't kick the dog!!! There is no way if you had kicked the dog that the dog would have been fast enough to bite you in the back of the leg. If the dog will bite you, it will bite a child. It's like I warned a friend with a dog that doesn't like children, and it would snap at any child that came close...you HAVE to muzzle the dog. No way can you not go out with the dog without a muzzle. In the US if you know the dog bites and you don't muzzle it you are liable for the medical bills, the damages and whatever the person wants when they sue you. Gabs, you need to get a lawyer (or solicitor) and sue this person. You have a witness to the fact that you didn't "kick" the dog. The owner is playing mind games with you in trying to make you the the person in the wrong. It isn't true. Any country with an ounce of sense has laws about vicious dogs and the owners keeping the dogs under control. Even if you had kicked the dog, it has bitten before and you were only protecting yourself. I am so thankful that you didn't fall as the dog would have killed you. Before you get too much more upset, stop and realize that the police are probably interviewing neighbors and other people about the dog and the dog's actions. If it bit you, it has probably challenged others. You can't be the only one that it has gotten nasty towards so there will be more evidence in your favor. You need to remember that you are in the right. Keep that in your mind...keep telling yourself that. Right now you are still in shock from the incident and still in pain from the attack (I hope that you are on antibiotics for the bite) so you are vulnerable to everything going on around you. You might need to go to the doctor to get some tranquilizers to help you out during this time of high stress. I had to when the neighbor pulled her crap about the sewing machine. It took a little time before I realized that I was totally in the right and she had lost her reasoning and memory. Then preparing for the case in court, it gave me the extra strength to go forward and win the suit. I got a judgment in my favor because I was in the right. Just like you are in the right now. Get a hold of your doctor and ask if he can give you mild tranquilizers, take them only when you are really starting to stress over the situation. If it helps you, post notes stating that you are in the right so that you get that firmly in your mind. I wish I could be there beside you to help you through this problem. I hurt for you and the trauma from the upset and the bite. All I can do is send you tons of hugs and love and say a lot of prayers for the situation to resolve in your favor.

It is very unusual for a Cocker to be vicious. There is something wrong with the dog, such as a brain tumor etc. As much as people love animals, it is sometimes necessary to put one down for medical reasons. Plus, like many other Lotters have said, the next victim could be a child. My neighbor was bitten in the face by a Doberman. It was a totally unexpected bite as the dog had been very loving and friendly before. After 150 stitches in the face and weeks of pain and bruising the lady was fine but very cautious around dogs. The Doberman was put down and the Vet found that the dog had a tumor the size of a golf ball in its brain. (They had to check the brain for rabies, just in case.) I can totally understand what you're going through, as I still am bewildered by the suit that the neighbor filed against me about that stupid sewing machine. We are due at a barbecue tonight and my boyfriend Bill has taken steps for me to be protected in case the crazy neighbor lady is there. (I am worried because she is a person who doesn't hesitate to hit people, and if she hits me and I were to fall, it might place me in a wheel chair permanently.) I still would like to cry out the pain from the whole situation, but I am still only tearful. I know that my situation is nothing like yours, and I really wish I could have been bitten in your place...(I've been bitten by dogs numerous times, and I usually can manage to give them a sharp slap across the muzzle. It makes them think hard before they do it again). In fact my daughter's mother in law has a really nasty tiny floor mop type dog. It has bitten everyone including the owner at least once if not more often. The dog needed its toe nails clipped and I volunteered. The first thing it did was bite me. I slapped it so hard that it rolled across the room and came back to bite me again! I had my daughter get one of her husband's DIRTY socks and I stuffed the dog's head in the sock. It fought the sock for a few minutes but the smell finally got to it and I was able to trim the nails for the dog. We removed the sock and the dog (It could breathe through the sock, HONEST!) could only sit there and suck in fresh air. We all laughed until we cried. I really wish there was more that I could do for you. It hurts me a lot to know that my friends are hurting and are having such bad problems. All I can do right now is send you tons of hugs and love and support. Please keep us up to date on your situation.
