Loop holes in the legal system ...can it ever be set right?

I am sure it is the case with every country's legal system.There are bound to be some loop holes in the system which one easily takes advantage of and makes maximum use of it.It is more so in the case of criminally minded individuals who are able to completely manipulate the system to their advantage .I sometimes wonder whether it will ever be possible to set it right and have a fool proof legal system which is secure and cannot be manipulated...Or is it just that no matter what you do the human mind is so corrupt that it is always looking for ways to beat the system..

There are people who are expert at finding a way to beat any system in place. To them it is a challenge and they will usually find a way around almost any rule. I think that no matter what laws we have, there will always be someone that will figure out a way to manipulate the system. All those great problem solving skills could be put to such a more beneficial use I'm sure.

Hi sid, thanks a lot for the response Thats exactly what I thought, that we can never hope to clean up either legal or any system for that matter in our life time, just go on with it and make the best or worst of it...All the best, happy mylotting

Hullo Kiran! Loopholes may not essentially help only the corrupt Kiran but occasionally they come in handy to the wronged party also[I have heard that my father was brilliant in looking at loopholes and solving the cases of his clients.He practised civil law however, where the cases were mostly on property dispute, illegitimate and unfair litigations.] The loopholes are provided for select exceptions and if the human intelligent but crooked mind uses it to further some unfair advantage, then we always resort to the old saying that these things may be manipulated in the human court but there is one divine court which is above all.

Hi kala, agreed with your views..The loop holes I am talking is about a certain law itself which is not clear cut and gives scope for misinterpretation. I had a case here with someone who had to loose her house after a dispute with her husband because of the benami act which was actually made to nab the corrupt individuals, but can back fire on innocent people..enjoy your day kala

Did she buy the house in her husband's name with the sourc of income being hers?

The house was in her name bought with their joint incomes. Since she was working in a private school she was paid by cash and she would deposit it into a joint account, so there is no account for her money...Now when they had some misunderstanding, after a long battle she has lost at the local court, but has now gone to the high court...

Yes kiran, there are some loop holes with every countries legal system. In law there is a saying 'benefit of doubt'. To protect an innocent person from punishment the judge considers if there is a doubt about the the misdoing of that person.If the judge find any doubt then he or she release that person. The lawyers take that chance and try to find out that loop hole to free their clients.

Thanks a lot for your views bhanu,I know that at times lawyers need to bring out all their skills to succeed even if they have to take the devious path.There are also some very confusing laws in our country like the benami act which is being misused...all the best and have a nice day
