How can they do this?

I know there are alot of opinions on smoking, do this might stir things up a bit. I seen on the news where the next town has put a ban on smoking in any public place or any property that the city owns. This includes all outside areas. They have also put into effect a new rule for city employees. They will no longer hire anyone that uses tobacco. My question is, tobacco is not illegal. How can they do that? If you will be in trouble if you are caught and cannot be hired if you use it, why do they not just make it illegal. But wait, they try to legalize smoking pot? Makes sense. If it is not illegal it should be discrimination for the hiring process. When is it going to stop? Next it will be alcohol, then colas, then fast food. The government is too involved in our lives now. The citizens are already putting up a fight? Do you think it will change anything? Do you think that the courts will say that they are discriminating?

Mesa arizona pban mokback in the 90s some what like that they had even said that ya couldnt smoke in your own yard!! Well last year we had a wedding to go to so ended up in a motel in Mesa and they had to cut out some of that banned for we could smoke outside the motel room. Employees they might have not many workers left. YEs the Government is to much in our business. They had a vote her in VEgas you could vote 2 ways and we went with how the bars would like it to go BUT the wording got ya and the ote went to no smoking in bars also! It was to be no smoking in restruants or places where kids were well NO KIDS should be in the bars. The bars are fighting it some even have signs up smokers welcome for it hurt thie business badly for the fime they had to pay if some one lite up in the bar. Now that one is realy rediculous huh?

i am a smoker and in certain places i can understand why they have bought this into effect,but pubs and nightclubs,come on this is ridiculous,if they are intent on this law then maybe they should change the law to,smoking is only permitted after 9pm,that way kids will be at home and unable to breath in the smoke,or maybe they should just have 1 or 2 smoking pubs and clubs in a town or city and the rest non smoking,that way the non smokers have a choice as to whether they want to breath in others smoke or not

There are a lot of places around me where you can't smoke, even outside, and I don't know how they can do it either. I know smoking is bad for you and that second hand smoke is also. I know it really, REALLY bothers some people, and I've always respected that and have never smoked near anyone who didn't like it. However, I think smokers should have some rights, too. I never complained through all the years of designated areas or when smokers had to go outside most places to light up. I know better than to smoke right by an entrance or exit or around children, etc. I've always respected the feelings of others, so why can't I also get some respect in this area? I think it's ridiculous that someone can be denied employment if they're a smoker. Sure, they can keep you from smoking on the job or on their property, but what someone does in their own time is their own business, assuming it's not illegal. The problem is, smokers are in the minority now so the overwhelming majority of people, even those who are always talking about other rights being taken away, have no empathy for us. Annie

If they are going to let it go this far, it should not even be available, and should not be legal. They don't want to do that because then we would have more people without a job.

i'm not sure how they're getting away with that one myself. we have some looney here that wants to make it fineable to smoke "within 1000 yards of a school". well,first of all,i wouldn't smoke right up near a school. but the problem here is,my house is near one.i don't know about a thousand yards,but..i'll be damned if i'm told i can't smoke IN my house.i have to put up with school bus fumes twice a day,and my cig is a hazard?whatever.

I don't know what will happen with smoking but you're right, the government is quickly beginning to control every aspect of our lives. I think the smoking might be because of health insurance costs if they are city employees but all public spaces? That's insane. While I understand non-smokers' objections and admit they are valid, there comes a point where their freedom is infringing on the smokers'. They don't outlaw germs but germs are everywhere, interfering with peoples' health--at least smokers aren't everywhere. It won't stop if we don't stop it here. I hope those people fight hard and win. Let the camel's nose into the tent and soon he'll be pushing you out, as they say. Right now the camel's whole face is in the tent so we'd better wake up and pay attention!

If they can go that far, they should just make it illegal. Until then they should not be able to tell you that you will not be hired if you do something that is legal.

I know it will happen (more and more and larger and larger government) but hopefully it will be successfully delayed for a while! It is happening in increments and bites..

It is confusing, but no I do not think the courts will say it is discriminating because smoking indoors or outdoors does annoy and endanger other people, so although it is legal to smoke, I do not think that it should be legal to smoke where o thers are trying to earn a livelihood. On the other hand I believe that the government is way too involved in our lives today.

It IS discrimination! However, since the government is doing it, they'll get away with it as they always do. Let one of us, outside the government do such a thing and we'd be hung out to dry! That's NOT right at all! Double standards is wrong plain and simple. Our government has no clue to what 'practice what you preach' means.

Good morning Rob, i am a smoker & i don't want to bother anyone w/my smoking but i am sick & tired of all the rules & regulations that are being enforced on smokers & other things. The aggravating thing to me [one of them anyway] is that all these people who are making jush a to do about smoking use to be smokers themselves. GRRRRR. tHEY ARE ALOT WORSE THAN PEOPLE WHO NEVER SMOKED. I agree the goverment gets to involved in some things & not involved enough in others. I never have been fond of hippocrites & i think that's what alot of them are.

Hmm, since I'm a non smoker I agree with the ban of smoking in public places. I know this make life difficuly to the smokers, but the nicotine is bad for health and passive smokers should not be harmed by the active smokers if they go on public places because in a way..it is unfair to us. In my state, the government slowly regulated about the public places where smoking is allowed, nowadays they ban smoking room inside the buildings but still allow smoking in pub or clubs

I would hope that at some point it will come to a supreme court decision as to whether or not choosing to not hire someone is a smoker is illegal. I think that it isn't right because I think that the decisions that people make in their lives that are legal should be something that would keep you from getting hired for a job. It is already not legal to ask a person's age or whether they have a disability when they are applying for a job. I think that legal habits shouldn't be something that is discussed when looking to hire a person.

Lol.. Is discriminating a crime?! Its just pose of opinion and it doesnt affect anything exept youre attitude towards the theme.. Even if they say its discriminating( I bet theres not) so what?! About being accepted at work.. Is there a law where you have HAVE TO BE ACCEPTED at a work if you want it?! I think not ... so think the owner of a company or alike has to accept you.. Is it hat suprising , Those are the standarts rquired to work at the place, just like proper education, clothes, and stuff like NOT wearing piercing and others.. Goverment interupting youre lives?! Give me a break .. you`re like a teen whose parents just said NOT To do somenthing ( MOM dont ruin stop ruining my life, I HATE you !!!) People these days are so let out.. With their rights everything... Rights to something is a form of service NOT Justice... Rights IS A FAVOR TO YOU.. DOnt go complaining about them..

I agreed to your points and i think its should be put into action. But today's world has no discrimination against this, some people smoke for pleasure, some smoke for fun, some smoke for warmth. But they don't know the effects occurring in their body and later result into heart attack and many other cardiac problems. There is restricting measures are still taken and people just continue. can any one suggest a good measure or preventive measure to stop it?

In the the state I live in they pasted the law that is in place now where you can't smoke in public places. It doesn't bother me because I am not a smoker. I have places that won't hire smokers. they are doing this because smokers are more likely to get sick. Most places who won't hire smokers will refer them to places where they can learn to stop smoking. I know the goverment is way to involved in alot of things. If it gets any worse people will stand up and fight!

I believe it's not discrimination. It is the duty of the government to look after the welfare of its citizens. Smoking affects not just the smoker but everyone around that smoker; second degree smoke, third degree smoke? A healthy citizenry is a healthy country, so why smoke?

I think it's actually good that the government is trying to discourage smoking like that. In the US and other developed countries the number of smokers have gone down because people are realizing the dangers of smoking and the disincentives that the government put in place to smoking. I live in a developing country and smoking is rampant here. I think my country is a haven for smokers. Everywhere you go you see people smoking in most public places such as certain malls, public transportations and even in government offices with AC. This is a nightmare for non-smokers like me. I even heard a statistic that 90% of adult male here are smokers.
