My ranting on Teacher’s Day

Today 5th September is observed as ‘Teacher’s Day’ here in India. I want to tell all that I had filed a case in the high court, in 1986, connection with my service, this was heard and order was passed in 1994 to give me the benefits, but the education department ignored it, so in 1996 I filed another ‘contempt of court case’, this remains undecided till today, they say, there are thousands of cases pending due to shortage of judges. I have retired in 2006; today I called my lawyer, who is fighting the case on my behalf. He says, “Don’t worry Sir; you will get your dues”. If not you, your wife will get, if she dies, you heir will get. [b]What an answer, I really feel sad and hurt. This is India!!!! What can I do? Today I was supposed to attend a meeting and celebration on this ‘Teachers Day’, but I am not going. Please share your views and comment on this. Thanks in advance.[/b] Professor ‘Bhuwan’. . 5/9/2011

Dear uncle very nice discussion I like it and do you know this is the main reason I left my practice because I have seen in most of the cases either party demand for the next date and the babu gives them next date after taking bribe. No cases are solved as early as possible and the poor and innocent people really bear the loss.. So I hate this profession even I have degree and registration number also. I seen all these in my one year practice. HAPPY TEACHERS DAY TO AND ALL FAMILY MEMBER FROM MY SIDE.. I am going for dinner of Laxmi Mata gnt sd.

Sorry to heard this but really I dont like Indian legal system. Most of the judges are not able to take the decision and now this problem are arise the judge is less how discasting..

Surekha beti Glad to know you are a lawyer aware of the system, the head-babu says, things are computerised, so no suffling of files can be done.. More over due to bad health i cant run to Cuttack,high court is there, lawyer lives in Puri.

Wow! uncleji thanks for BR. Yes uncle I am lawyer computerized system applied with in few years and I left my practice in 2005. So in our tradition one sentence is always popular "Court ki sidi kabhi mat chado" really not like the way of Indian legal system.. But you know who tell me do the LLB the TADA judge J.N. Patel they impressed by my communication way when I meet him at Mumbai. They tell me do the LLB and I joined three years course. No I feel bad why I do this.. My junior brothers thanks for comment I now know about it after your comments I check it..

Pranam Sir. A Happy teachers day from me. I was to send you a PM. Reading this I can realize how India truely is. I have seen a case running in my family - My Grandfather, then My Father and then it has come to me... (only my grandfather has expired in 1995 Daddy is still alive but as he is aging, I have to take care of this now...) (being eldest in the family is always an uneasy task). I can very well understand the frustrations involved and the worst is that no one wants them to get things resolved... the easy way. The lawyers too play a foul game here as longer the case, does mean higher and long running returns... I dont know if this will work for you or not, but I am considering an out of court settlement as I am not in good health these days and also I do not want to spend my time on the case and pass it on to our next generation... tough task but someone has to start this and hope that the other party too understands.

THat is sad not to get paid for a job SHotage of judges shouldbe the case of why they didnt pay you when ordered too back in 1994. Hope ya get it while you are alive

Hello Sir, I don’t know how he dares to assure you such a promise. In our country it is not a surprise at all. It will be a surprise if any case solved quickly. My husband met an accident in 2005 and last month we got a letter from the Court, asking him to present before them, after six long years they called for the first hearing. I don’t know how many more years they will take to complete the case and provide compensation for us.

Dear Papa! This is sad to hear that your case has gone on and neglected for so many years. Our system here is also slow depending on the nature of the case but I do not believe it is neglected for this long and or longer as yours. I am truly sorry to hear that your own Lawyer stated these words, it is as if he too did not care on the importance of this case. I am sure there is nothing further one can do with all the governmental issues in India and or any other country facing this. The least the lawyer by now could have offered more action and or pressure towards them. But it seems that he does not care as much as you do. I am sorry to hear that you will not be attending and I really wished you had because it will show them that despite their terrible ways you are the bigger one in honoring this special day. Happy Teachers Day to you Papa and hope that this can be resolved during your lifetime and not when you have long passed. What I fear is that although you have a lawyer that their will be less pressure for anyone to pursue this is if you are not around.

Hi beta Even if the case is resolved, there are many kinds of follow ups to be done in the government level, next in all the colleges where i served in 46 years, next arrears bills have to be prepared, passed by treasury, you have to give tips=bribe at each step, neither i can run nor i will pay.. oh thats india.......its damm filled with corruption the whole process of litigation took so much time ...its so sad to hear that seriously its sometime its so disheartning the way system is ...people cannot stand up for their own rights even if they take a stand no one listens to them i hate the congress

Their refuses to obey the court order should have been dealt with swiftly and decisively. I knew our court system was slow but that's mostly due to the lawyers filing motions and appeals. It is ridiculous that your case has taken so long. I hope you win it and get what's due to you long before you pass on so that you can enjoy what you've earned.

I have no idea what your case was about so I don't really know what to say. I think it is ludicrous that they can't get this straightened out quicker. Pretty sad that they said this to you about your wife or heir getting the finalized winnings on the case. But if it is back logged from 1986 it should be a great amount. I wish you luck in this.

Hello my friend Professor2010 Ji, WEll, I salute to your patience, but fail to match our daily life with your age. I think at this age of your, on 3eshould understand, where to taken panga, and where to keep quiet. It is a part of game. This is our life. My alone case regarding desparity in pension has been decided by Chandigarh AFT on 31-May-2011, and it is to be implemenyted by Oct-2011, I do not have patience. lawers will have their own fees. If they finish the work, then they have to go for starving. Just keep yourself off from three professionals, Doctors, Lawers, and Police. It is sad to hear how teachers are treated in many parts of the world. I think they should not make teachers go that road of having to go after their benefits. They deserve these benefits and should not be saddled with court battles. It is so sad.

I am so sorry to hear about this. I'm glad that your lawyer still represents you. I hope that you get it one day. I'm sure you deserve it. I wish I could say more, but I don't know the extent of your situation. What I could say more though, is believe in justice from a Higher Power.

Really sir this is bad news and in India most of the cases not solved only due to less judges and some is party is not ready to solve they are interested to takes next date, next date. I not understand why the Govt. not taking any action against this..lots of innocent people are suffered due to this legal system of India.. Now how they tell if you not get benefit your wife may be get or your child may be get..they are foolish..

oh P rofessor this has brought tears to my eyes to read you were so mistreated and still have not got your dues.your lawyer was not very kind saying you will get your dues, if not your wife will blah blah. thats unfair.You and your wife need this now as I know having diabetes is not a cheap disease.I also feel hurt and sad with you.wish I was there to give you and your lovely wife some hugs for this awful time. You deserved to have that money a long time ago. I do not blame you for not wanting to attend a meeting and celebration for teachers day when you have been so mistreated bv y the high court.I am sending three hugs from hatley lol.

Professor, I am truly sorry that you are caught in this legal tangle. I have to admit that maybe our own legal system here in the US is better than I gave it credit for, in comparison. Usually cirminal trials are fairly fast, due to our laws to bring the accused to trial very quickly in criminal cases. Civil suits take much longer and can drag on for years, but I personally do not know of any that have dragged on for generations. It's usually the lawyers, here, too, that keep asking for the delays. Our legal system is getting more corrupt than it used to be, reflecting, I believe, that people seem more tolerant of corruption these days as morality in all areas of life deteriorates. It is interesting to get a glimpse into how things work in other countries. I wish for you a resolution in this matter so that you will get what you have earned and deserved.
