Just When I Thought I'd Heard It ALL...I Read....

Due to his need for an umbrella to protect him from the rain, he runs across a set of tracks so he could meet his train. The umbrella blocks his view of an oncoming Amtrak train traveling over 70 mph. Yes, he's hit by the Amtrak & his body is ripped apart. One large piece flies through the station hitting a 58 year old woman, knocking her to the ground thereby breaking her leg & wrist. This woman sues the dead boy for causing her injury. The judge ruled in favor of the deceased. The lady appeals & now a State court rules that he should have known that if hit by a train that his body could possibly injure a bystander. WTF??? That's like saying the lady shouldn't have been standing on the platform because she should have known there was a possibility of flying body parts. It was ALL an accident & I don't feel anybody was at fault!!! The lady's attorney claims “If you do something as stupid as this guy did, you have to be responsible for what comes from it.” The Mother of the boy sues the railroad because she said they neglected to announce that her son's train had been delayed & there was no need for him to rush. The judge ruled that it's NOT the train station's responsibility to announce all delays. I find this right up there with placing a hot cup of coffee between your thighs & suing because your dumb azz got burned!!! Can you imagine the pain & suffering the immediate family of this boy is going through??? After going to the link, what are your thoughts on this whole situation???

This is a bizarre accident. I think accident is the key word here. He should have been able to hear the train coming prior to his crossing the tracks. Really don't believe an 18 yr. old should be held responsible from the standpoint that a teenager's fear level at that age can be nada. I doubt he was analyzing the whole thing and thinking about himself being hit and his body parts would hurt another person. I would think Amtrak would be responsible. You know, like the driver of a car who hits something should have had his car under control at all times. The end result is so sad. My sympathy to the young boy's family.

As strange as this may sound...if you're standing in front of a train, you seldom hear it coming at you. In this case, he was in a train station with many trains around him. It's pouring down rain & he has his umbrella tilted down to protect himself. I can see how he got into the situation; however, I don't see how he should have known that if hit that his body parts would fly & hit someone. I've read of 60 year old men running across tracks without thought & this guy was only 18 with absolutely NO fear that his life would ever end!!!

I think it's ridiculous. Your right that it was all an accident and that no one should be held accountable. The boy lost his life and that is the worst thing..then an injured lady sues him for a flying body part? I hate it for the family...they are the ones she is trying to squeeze money out of. I think that there are just some people that will sue over anything they can if they think they can get a dollar.

The young man was only 18 so i seriously doubt his estate was very large. So, I just don't understand her need to sue!!! To me it appears there is more torment for the family than monetary satisfaction for the woman!!!

As they say, truth is stranger than fiction! I cannot say that I have heard more weird than that, but I do remember the lawsuit about the hot coffee and was quite shocked when the butthead person won!

This is just crazy. The lady just wants money. I think if something like that should ever happen to me I would feel the need to give what I could to the young man's family. This is just one of those things that happen. Everyday we that we wake up we all face an unevitable danger. We just never know when something like this can happen. Recently my small town suffered a huge loss when 3 of our community members was killed in a freak accident. A young lady had trouble with her van and had pulled of the side of the road. Called her mother to help. Mother responded and they both had clearly pulled off the road. Boyfriend had to work the accident. A neighbor responded. A wonderful man who didn't have anything to spare but kept several other community individuals with produce which he worked hard to grow. He was helping the two lady's with their car trouble and a dump truck hit all three killing them instantly. It was an awful loss. This elderly lady should be ashamed of herself. For wanting the money and tying up our court systems with this matter.

Yes, I agree that she's just being greedy!!! I used to have a friend who always wanted to borrow my car. He wasn't a very good driver, so I always declined his request. He got upset at my NO one day & said "I'm NOT going to wreck it on purpose." So I asked him how many people ever left home saying "I think I'll wreck my car today???" He had no answer & left without further discussion.

This is absolutely ridiculous to me! People never cease to amaze me at how guilty they really are. It's hard enough to deal with the loss of a loved one and then to have to deal with someone being greedy is insane!

Whats happening to our law and order. Wow .. Imagine a railway station which doesn't announce any delay reports. Just when a family needs condolences... this lady has to file a law suit against them. Great..... Sue the court and its jury who gave such insane judgment. Then throw that lady number 58 in a mental asylum. I wonder if she's gonna quietly stay there too..

I have watched as our nation has slowly lost its direction!!! The thinking seems to be "it can't possibly be MY fault ...so who can I find to blame"!!!
