The 25th Amendment And Section 4! Down The Rabbit Hole!

United States

In light of recent calls for the invoking of the 25th Amendment Article 4 of the US Constitution, I have decided to write a little on why it is unwise to go down this path with President Trump. Section 4 deals with the competence of a President to perform their job. Some background for it is needed to understand the intended purpose rather than the proposed purpose some wish to apply today. This particular aspect was drafted with consideration to several specific past events. 1. President Woodrow Wilson suffered a stroke and was incapacitated. 2. President Dwight D. Eisenhower was incapacitated due to health problems several times. The original intent of Section 4 was not to remove a President for what amount to personal reasons but rather to give guidance in cases where the President was incapacitated and could not invoke Section 3. It further seems that direct medical/ Psychological proof would need to be available from a professional both qualified and directly in contact with the President rather than perceived observations from people who are in contact or observed by the general public. At this time there has been no push for an independent Psychiatric evaluation nor any medical evidence provided for President Trump. If Article 4 of the 25th Amendment were to be invoked with what people are using at this time then it would be available for immediate use on all further Presidents without Professional assessment. It further would beg the question, why couldn't it be used in the past to avoid any need for impeachment proceedings? If it were to be used for President Trump today under the present conditions then it logically should have been used for the past 5 Presidents and could be used on every President "At Will" to circumvent elections without respect to the election process. What do you think? Should the 25th Amendment section 4 become a constant way for one party to gain control despite what has been decided?

Thank you for this post. I have to admit, that I wasn't as informed previously as to what the intent was!

@SonjaRae No problem! People are calling for this to be invoked without any basis in fact. They simply don't like him and want him out at any cost! I'm not a big fan but if this were allowed it would instill a precedent to remove any President for purely political reasons!

Well, I don't recall any of the recent presidents not being able to find their limo as they descended from Air Force One when it was smack in front of their face. Or getting up randomly and walking confusedly out of a press conference with a foreign head of state. Or getting up and walking out of a televised signing of an Executive Order without actually signing the EO. He clearly sundowns pretty frequently because we see it often enough during his public appearances. Hopefully the 25th Amendment won't need to be invoked. Mueller has enough stuff on him to get him out of office. I just hope it is soon.

@NJChicaa Could you please share video proof of what you are saying. Again that would need to be determined by a Medical Professional who had actually examined him. As for not seeing it in any of the past Presidents, I have to wonder if you would admit it if you had. It has actually happened with those previous leaders and in some cases even more concerning behaviors! On the basis of that Hillary never should have been a candidate in the first place. Muller has bigger fish to fry as there is clear evidence of the past administration AND the Democratic Party as a whole Colluding with foreign actors. Look no further than Wasserman Schultz and her IT people who have fled the country or were arrested while fleeing! FYI they were getting paid far above reasonable pay AND were not fired until they were arrested (after charges were filed).

@NJChicaa Back story on that... He was trying to go greet a soldier off screen and was told he couldn't by secret service. Not necessarily what it appears to be.

@NJChicaa Not completely sure on this one but as I recall he opted not to sign it in front of cameras because of some issue with reports about the particular order which were not true. Both are definite signs of something going on but not necessarily what your making it out to be.

I agree with you that this is not the way to go with Trump. It was originally set up to deal with health issues that render a sitting President unable to do his job. Trump does not appear to have any conspicuous health issues, at least not until they declare stupidity a health issue.

@sumofalltears Well if stupidity is declared a health issue then we will be without a Government! LOL!

@dollaboy No problem. Sadly some people are coming up with unconfirmed 'medical' diagnosis's to justify using this Amendment and section. Very sad.

@jstory07 Yup! And yet the Establishment and those uninformed are trying to interpret it to fit what they want it to be!
