I wonder if employers should be obliged to encash and pay the unused leaves of their employees especially on the end of their contracts?

In France it depends how the contract is written. If it does not authorize to take leaves, they have to be paid by the employer at the end of the contract ; if they are authorized and you did not took them, they are lost and not paid.

@topffer i think he didnt refused but since she had a contract of 2 yrs she never took it expecting that she may encash it if her contract ends as an additional benefit she may receive.

In Philippine labor law, unused sick leaves and vacation leaves are paid. However, there are conditions. In most of the companies I've worked with, all unused sick leaves are convertible to cash. However, there is a limit as to how many unused vacation leaves can be converted to cash.
