Abortion is Illegal

You may have heard the so called mainstream news pundits raising quite a fuss lately about the retirement of Supreme Court Justice Anthony Kennedy. The main cause of their concern seems toncome from a fear that President Donald Trump will appoint a judge that will help him make life a right. Which would overturn Roe V. Wade; making abortion illegal. However the fact is he doesn't have to overturn anything. Abortion is illegal, and the Roe V. Wade descision was an illegal judgement. What do I meana? I present to you for reading the Constitution of the United States of America; written by the founding fathers of the country. 39 witnesses signed it, making it a legally binding contract to all residing within the borders of the U.S. To further emphasis it's legal importance I point your attention to Section 2 of the Cnstitution. It reads: 1: The judicial Power shall extend to all Cases, in Law and Equity, arising under this Constitution, the Laws of the United States, and Treaties made, or which shall be made, under their Authority. SOURCE: constitutionus.com/ So we see that all laws must reflect the constitution. What does the constitution have to say about laws? It says the following. Article 1 Section 1 US Constitution: All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives. source: constitutionus.com What are legislative powers? Legislative (def.) having the power to make laws. So by authority of the Constitution only Congress can make laws. Roe V. Wade was a judicial decision made by the United States Supreme Court in 1973. What is the power of the judicial branch? The judicial branch interprets the meaning of laws, applies laws to individual cases, and decides if laws violate the Constitution. It's comprised of the Supreme Court and other federal courts. Again we see that the judicial branch cannot make laws. source: https://www.usa.gov/branches-of-government The ruling in the Roe V. Wade decision does not apply to anyone not involved in said case. Only congress has the power to legalize abortion. The only purpose of the courts ruling was to decide the constitionality of laws prohibiting abortions. Who were the opposing sides in his case? Norma Leah McCorvey Nelson. Known by her legal pseudonym "Jane Roe". And Henry Wade. The district attorney of Dallas County. The ruling becomes a court precedent and would be used to determine future rulings with the same circumstances. But it does not become law. So was the ruling correct? I now present for your reading the United States of America's Declaration of independence; adopted by the second continental congress, which has been granted sole legislative powers by the US Constitution. It reads: We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness. What is the use of the term "men" in this instance? The same meaning given to the term when it is found in the Bible. It is short for mankind. How do we know this? The use of the phrase "...endowed by their creator." This implies a God or Supreme Being, and directly refrences the Biblical Scripture discussing the equality of mankind. For example Romans 2:11 which reads: God does not show favoritism. The fact that this term has never been changed stands to further identify it to apply to all of mankind. man·kind noun 1. human beings considered collectively; the human race. hu·man be·ing noun a man, woman, or child of the species Homosapiens. child noun a young human being below the age of puberty. This is any human offspring below the age of puberty. Is a fetus, embryo, or sny other state of the life form growing within a human female anything other than human? No. We know this, because humans do not have the ability to give birth to any other species. And so the Declaration of undependence also applies to the human growing within a human female. "The right to life." What is it called when the right to life is trespassed upon? mur·der 'm?rd?r/Submit noun 1. the unlawful premeditated killing of one human being by another. What is abortion? The premediatated killing of one human by another. Thus the Supreme Court decision was in direct violation of the United States Constitution, and it's status as a precedent is void. Which makes every case refrencing Roe V. Wade's decision as the basis for their judgement illegal. Only congress has the authority to make laws, and no law can violate any previously consritutionally created law or it would risk the validity of any other law related to said law. In other words if Congress were to legalize abortion, it would be in violation of the right to life for all mankind. This in turn would undermind laws against murder of men and women and other laws of equality. So abortion is not legal, and never will be legal as long as the Union of the United States of America exists.

The Constitution, when signed (all men are created equal) did not include slaves. How do you explain that?

The statement "all men are created equal" would apply to everyone making slavery illegal in the US. Another time the American judicial branch over reached and went beyond their authority. The case was Anthony Johson (a black man) who went to court to fight for the right to keep John Castor (another black man) a slave. The court granted it to him, supposedly making slavery legal. However as Congress never approved it, then it was in fact not legal. I guess one could play devils advocate and say that men were equal in freedom and slavery, as all races were enslaved. Not just black. Whites and Asians too. But if one man is to be enslaved, then all must be or equality is lost. So that excuse would not fly.

@redhotpogo Equality is a word widely used but little understood. As a right, it must mean respect for others. And pages could be written about the lack of respect towards others that lead to spite and to wars.

@marguicha When Thomas Jefferson wrote the Declaration of Independence, he had a reference to slaves in it. However, there was an uproar from the other members of Congress who had slaves, and he was forced to take out the reference to slaves, which would have granted them their total freedom right then, instead of waiting until the Emancipation Act proclaimed by President Abraham Lincoln.

I wonder if they will outlaw abortion in the future. Personally I wouldn't ever have an abortion. In England abortions are allowed up to 24 weeks pregnancy. In most other European countries abortions are allowed up to 12 weeks pregnancy. It is always going to be a very emotional subject. My mum's friend Jo and her husband Bob adopted 2 children in the 1960s. These days these unwanted types of people would be aborted. I am so pleased they were adopted to a loving couple.

Whew that was long. I prefer the ten commandments than this. These were made by people and there a were always loopholes and biases that will come around

There are no loop holes that allow for this. But they can lie, and judges can look the other way, and no one can hold them responsible, and life goes on. Well... not for everyone.

Legal or not, the constitution needs to be amended. Times have changed quite a bit since then. Abortions should be a personal choice.

I don't agree with abortions, unless the person is raped, but they are allowed, up to a certain time. so not sure they are against the law..

Politics tend to lose me. Abortion? The dividing factor seems to be on when the soul joins the body. Or at least one of the dividing factors. I think, even if the soul joins the body after birth - that embryo still had a chance to contain a soul/would have had one had it been allowed to live. I think abortion should be saved for cases of pregnancy after rape, incest or in the cases where it is a needed procedure to save the mother's life. Otherwise I think it's too close to murder.
