I had the strangest call this morning and it wasn`t even a telemarketer. Let me explain. A couple weeks ago I attempted to buy property, a small rundown place but with good bones, I had intending on opening Sunshine`s homestead creations there. I lined up the attorney and the day before signing the deeds came back tainted, this guy bought it from an estate and the estate sold it but it was against the law the way they did it. I called the man and told him, he got mad and told me he had another buyer. I am out $75 to the attorney for the work they did. Some you win some you don`t. This was no longer even in my thoughts. I got a voice mail from one of my attorneys, the estate attorney. Saying : Hey Andria, I have been looking over the deed of that Land that Mr. **** got from Mr. *** and I think I can fix this. I called the original owner and asked about the estate, three signed, three died, and two will sign, then he got into the law about probating the estate, which I already know. Then he told me this and my mouth dropped while listening : I can fix this deed with the help of Mr. *** he will get the others to sign, it`ll take a couple hundred dollars but I can get that done, so come by and leave the money and I will get on this for you. I called back but he was out for lunch so I left this message : Hi, this is Andria Perry returning your call, I do understand the probate process and what needs to be done. I am no longer interesting in buying this property but you should contact Mr. *** who needs his deed corrected to sell the property because the original owner did not give him a clear deed. There is absolutely no way I would pay for this man to have his deed corrected, over the years I have inquired about this property and the amount has went down each time, finally to a low price that I would pay and I now know why, his deed is tainted, AND with me dealing with him the few times I did I am sure if I paid to fix his deed so I could buy, he would not sell and I would be out of more money. I will make a suggestion, call Mr. *** and tell him that you can fix his deed for a couple hundred dollars. I do appreciate you thinking about me. The end of message. Although that sounds mean how I said it, I was sweet as sugar. When I hung up Tony said " that was perfect." I think its time to find a new estate attorney. As the old saying goes " I ain`t as stupid as I look!" I shake my head..... hey! Happy Friday.

Honestly, I do not understand transactions at your end of the world. Out here, we do show xerox copies of the deed for perusal when we take the person to the site for verification. Then the negotiations, and some monies are paid upfront...and we enter into agreement for sale. And finally on the date of registration, we go to the registrar's office, there we sign the deed and receive the final amount. From what you have mentioned it appears that the person did not show you the property document upfront and signatures of a few heirs were missing on the previous document. In this context, I would think dates are important. Do you all have search records? If the person has been holding the "tainted" document with no claims lodged against it, then it may not be such a great issue as adverse possession rules might become applicable.

@andriaperry While that is so, the search record would show whether or not the person did claim his or her rights in time. If he has, that is touch me not property.

@andriaperry Ah...I got it... no you shouldn't be asked to pay for fixing that deed which you are not going to buy or even buy in part. And it does seem that heirs of no.1 have claims, which means fixing is not a good idea. Do adverse possession laws hold good in your area? If the heirs of no.1 sold it say in 1950's, then how can they claim in 2018? Especially if they have not filed any case since then?

@vandana7 I am not sure of the statute of limitation in Alabama about this. I would think so, most of this dirty dealing is because the person selling refuses to hunt down the heirs.

@andriaperry Badly enough to check his common sense at the door, apparently. I'm more wondering just what his relationship with the guy who has the bad deed is. It just doesn't make any sense to approach a client who has no connection to the property in question aside from wanting to purchase it. Maybe he thought that you were interested enough to consider the fees for fixing the deed a worthwhile investment? Even so, it doesn't make any sense because you have no guarantee that the guy will follow through with the sale after the deed is cleared. Are mobsters going to come break his kneecaps if he doesn't come up with a certain sum of money by sundown?

Was there actually a title report done on the property or was it just an opinion by the attorney? I think that your state is a title insurance state. Sometimes things like this can be fixed pretty easily.

Yes he ran the title/deed for me, his assistant told me to walk away since their was heirs that have not signed off from the previous owner. I have done quit claim deeds myself, but those were for an estate that I knew did not have any debt. No Alabama is a buyer be aware state. However, when I buy property I always have a title search done and I buy the insurance, because I buy the insurance the insurance company also does a search to protect themselves. Yes it costs but worth it.

In our country India, there is a big nexus of real estate mafia and you really have to do a thorough investigation before buying a property. You can be easily cheated and fall prey for an illegal transaction.

It may be worth trying, but all he got out of it was jaw exercise. You are not stupid, nor are you so in love with the place that you would hurt your own pockets. $75? That is what my plumber charges for an hour.

Beautiful? Not hardly. He knows I buy and sell real property and since it would be a full closing, meaning more money for him. All my life men try to tell me what to do, or what I cant do. I always prove them wrong.

I got a call a while back that I had some papers or forms to sign. They were going to come by my house for me to sign them. So I waited nobody came. Got a second call the person said the same thing. "If I don't sign the papers they will take legal action against me. Till I figured it out and everytime he called before I said anything I started screaming "SCAM SCAM SCAM SCAM" I never heard from the guy again. He wanted to trap me in some kind of payment plan. I looked online and it was a scammer.
