The basic argument is that the doctors are bound by an oath not to turn away any patient and it is mandatory for them to treat a critically ill patient when he knocks at their door. There is, however, no law that says medical professionals cannot go on strike. That is unless the Essential Services Maintenance Act (ESMA) is invoked. 'strike at the cost of patient care is not acceptable. But what is the alternative when genuine grievances are not addressed by the administration?

No. Nomatter what happen to doctors, they should try to solve problems by any other means rather than go on strike. Being a doctor, they should know very often a life can not wait until you solve your own problem. Life is more important than anything else. If you put your own benifit above your patients' life, you are not quolified to be a doctor.

I think the doctors will always be bounded by their oath. But there is not enough doctors in any hospitals, there bound to be unfairness in their work shift. I mean, doctors will have to work long and tiring hours. I dont think they would want to go on strike because the doctors know very well that their profession requires them to be on a standby all the time. Their job is to save lives. Whatever their problems are they should not resolve it by going on strike.

It requested the court to bring to an end the 'needless loss of lives and sufferings of patients due to abrupt strikes of resident doctors at different hospitals in Delhi and other cities, including shutting down of emergency departments' as it violated the right to life guaranteed to citizens under Article 21 of the Constitution.
