Landlord Says "You can live without air conditioning"  

No, You can not live without airconditioning, I live in Arkansas it has been over 95 degrees for weeks, there is no way anyone should have to live in these conditions.You should report this landlord to someone. It is not good for you or your children to live like this, a lot of people die from the heat.You pay to live there, this landlord is responsiable to fix this air for you. That is why you rent!!

Check your lease! first step, go to your landlord one more time. If it's on your lease you got him if not ask to speak to the property manager,he should have one if not go to the owner! Last resort get and attorney and you'll win because it's in the unit so it's implied, that it functions! The attorney will get his $$$ out of the settlement, it won't cost you anything except time! Turn him in. Put your request in writing and put a reasonable time limit on it like 3 days. Point out the things you pointed out in your question..heat advisory, small children, 100 degree rooms. Send him the letter certified and make a CC notation on the bottom to the state agency in Florida that handles this kind of slum housing issue.

I'd also include a paragraph of intent that if the issue isn't resolved in 3 working days you will hire the work done yourself and the manager will be expected to reimburse you.

Civil court can get that taken care of for you.

I think the landlord would be better in dealing with the ac due to the fact that you have littles ones in the house. But you have no way of knowing how people will act. You just have to keep bugging him/her until they get you the ac. In the mean time buy mad fans that helps some. YOu have to say on the landlord; if you bug him enough he/she will get you that ac.

There are two actions that you can take that will get this landlord back on his job. First, I would call the Board of health and tell them the living situation that is going on. If they don't jump down his throat and get him moving then I would place my rent in escrow. If you are current on your rent, then you are allowed to take your rent to the courthouse for them to hold until your landlord makes repairs, with thirty days notice to the landlord of course. Most landlords don't let the thirty days go by before the repair is made.
