Breach of Tenancy!!  email this discussion to a friend?

Ooops Loud got a letter about her garden.I received it yesterday but only opened it this morning. You know how it is postman comes, too much going on,letters thrown to side or binned if rubbish...

So this letter says that during their inspections they noticed my garden was over grown in parts..yep ya got it,its those famous weeds again ha.Ok i did cut down some,i also called for an uplift, had items removed that really should NOT have been there,i cute back 2 bushes, especially one one path,so people could have access to front door, tho what the point was i have no clue as everyone jumps up & over the small rockery (used to be lol )on to grass then to door...

Goes on to say i have 7 days to rectify the situation.A further in spection will be carried out after 7 days.If i fail to comply & they the landlords are forced to do it,i will be charged £100..like WTF.w00t

Now i have been in this speciific house since 2000.The garden has always been done. This is the first time i have ever been warned. In that time,i have bought 3 lawn mowers. All of which have broken due to the heavy load of garden work, the garden could not take it.To keep on top of it i have to do it daily.Well i have no interest in gardens at all.I have a lawn mower which i bought last summer, its knackered.I have been quoted around £60 to have it fixed, the lawn mower itself cost £120.
Maybe i am stubborn???? rasp but i dont see why i should have to pay money for a lawn mower to be fixed that is going to get broken again, unless i am in garden more or less 24 7..blah..
Yeh so it say,if anyone in the household is incapable of tending to the garden, then contact them & they will see if i meet the criteria for garden aid scheme. It could be any health reason. Now i am physically ok,so i dont think i would qualify...

Hmmmm but i thought maybe i could tell them my son is still having seizures ( HE IS NOT ) & that i have to go help my dad every day because he had a stroke..which i do,i am there 3-4 mornings every week, unless he is having someone come to take him out...like today.

Do you think i should use those two reasons. They are both true but i would perhaps have to exaggerate a little..What would you do?

I have until next Monday or else..
In 5 mins i shall call them..gosh i hate talking all posh on the phone..haha..

oh just noticed perhaps this should be in garden interest.no matter now!!

I would be trying to get on the Garden aid scheme Loud.
And If you fail to meet the criteria then,

Maybe you could pay a neighbours kid to do your yard Loud.
There are always kids going around looking for work to earn pocket money.

myLot reputation of 68/100. LoudnProud (6249)  4 years ago

Yeh but there aint no kids around here Goodie, well there are but they are either older, like my sons age & not interested,or too young.Machinery of some sort would have to be involved anyway..lawnmowers,strimmers etc.I cant take responsibility for others peoples kids should anything happen to them ya know..
Anyway i called council.I told the guy about my son & my dad.He said OK..right..
Then asked about the catlogs,i said i had removed some myself but since i sold my car i cannot even take them to skip myself,or get uplift because bags keep busrting cos of weight of books..Theres about 100 catalogs sat at back wall.
You will never guess what he said..he will be up later today in his own car with bags for me..good strong ones.I have to put catalogs in bag,he will then come pick them up & take them to skip for me..WOW have you ever heard such a thing Goodie..
As for what will happen about the actual garden..fingers crossed what i said will be enough..he only said OK..like what does ok mean ?
Guess i find out later today ha lol

Well my dear Loud, I think you'd better come up with something
like you'd better have a bad back or knee or wrist or I don't
know but something quickly so you can get out of doing whatever
the he11 they want you to do! If you don't you'll be mowing
that lawn with a pair of scissors if you don't come up with
some kind of story! I'm trying to think of one of mine cause
I'm usually full of them! I try to get out of everything anyone
wants me to do, but I was never asked to take care of a garden
since I don't have one! You may have to give me a little more
time on this one. I may have to put on my thinking cap to come
up with something to get you out of this mess! You sure do get
yourself in some kinds of hot water don't you missy? Never a dull
moment with you eh? It's 4:15 am and haven't been to bed yet. May
have to sleep on it a bit. Will let you know what I come up with.
Won't give up till I think of something!

myLot reputation of 68/100. LoudnProud (6249)  4 years ago

Oh i will just cry & if the guy who comes up later is wearing a suit..wellllllll
woooooooo lol
I told it all to Goodie above, cant be bothered writing it again.
No dull moments here Opal...ok yes you have a good sleep & hopefully by the time you get back here all will sorted !!happy

Hi LoudnProud, We have a yearly inspection in the house I live, they come in and check for holes in walls, doors, general decor, the works, including the garden, I am lucky as I have no front garden it is just steps up to the house and the back garden is so small it is more of a yard but a few years ago I moved into a hous ewith a very large over grown garden and to rectify the situation I had a 'garden party' I invited all my mates round to bring tools and able bodied help on the understanding that I would provide beer, wine and grub if anyone wanted other drink like vodka they would have to bring a bottle. They all worked extremely hard and the garden got done so it looked reasonable. It was strimmed down first and then mowed but as very large garden we had a few strimmers and mowers. Worked for me so maybe you could organise a garden party. Good luck with it all. I would explain to the people about your dad and your son and the fact that you can't afford to spend out a £100 for them to do it and you think seven days isn't enough time and ask for that to be extended. Ellie :D

That sounds a lovely fun way of getting round an obnoxious obstacle - well done!

myLot reputation of 95/100. ellie333 (8050)   ranked 63 out of 26,919 in people  4 years ago

Just had another thought get some guinea pigs and rabbits round they will munch it all down for you in next to know time. Ellie :D

myLot reputation of 68/100. LoudnProud (6249)  4 years ago

noooooo dont mention the inside please..ahhhhhhhhhh noooo !
Gosh its bad enough with the garden Ellie shockedI will admit there is slight damage in the house, nothing too drastic, just me gettig mad..ON OCCASION & punching doors or throwing things at walls..oh noooooooo

Anyway yes thats a great idea about garden party..If i dont get anywhere with guy this afternoon i will for sure do that..More is said in reponse to Goodie..

happy

myLot reputation of 95/100. ellie333 (8050)   ranked 63 out of 26,919 in people  4 years ago

Oh thats great what a nice guy to come and shift them himself hopefully he will sort the garden somehow too eh! Ellie :D

myLot reputation of 68/100. LoudnProud (6249)  4 years ago

He has been up now,was nice enough about it,& gave me the bags said he will pick them up in his own car on Saturday shocked
As for the rest, well i dont qualify for garden aid,so he will be back on Monday to do another check, see if i have done anything..then i will get another 3 day warning letter, after which they will send garden aid to do it,which i will be charged..wait for it..

£300..based mainly on garden size..

Now i am lost..no clue what now haha lol

myLot reputation of 95/100. ellie333 (8050)   ranked 63 out of 26,919 in people  4 years ago

shocked£300, that is a lot of money, at least he is gonna sort the catalogues, my next move now then would be to concentrat on the front of the house garden and try to tidy up as much as possible over the weekend so he can see that you are making an effort and meanwhile try to speak to mates down the pub etc to see if you can enlist some help rather than have to pay all this out. Good luck.

I was going to suggest a case of beer and your mates from the pub. They get the beer at the end! Ellie got there first though. Of course, you could always get the children in the garden with a buried late easter egg hunt. They'd pull up all the weeds whilst they hunted. As Ellie said as well, call for more time. You have other commitments too.

I remember your 'weed' problem and now ita is not just confined to the weeds but the whole garden? shocked
The above response is a great idea and I was going to suggest something similar.
Like if you've got to spend £100 anyway then spend it YOUR way. I'm sure you'd find lots of school kids or pensioners who would do a lot of clearing up for that amount.
Not sure about telling them about the reasons you are not having enough time to do it as would that relove the problem? The weeds have to go so I think you should think about removing them or getting them removed than thinking of why you have not, and will not in future, done so.
I'd give you a hand if I lived nearer to and it's a pity I don't. All that fresh air would do me good (sorry rambling blush).
Rather than give them that amount give it to ANYONE to do the job - that's my opinion.
Good luck!

myLot reputation of 95/100. mysdianait (20643)   ranked 825 out of 26,919 in people  4 years ago

oops relove the problem should read 'resolve the problem'

myLot reputation of 95/100. ellie333 (8050)   ranked 63 out of 26,919 in people  4 years ago

I wished I lived nearer too cos we could have all had a garden party at LnPs eh! Ellie :D

myLot reputation of 68/100. LoudnProud (6249)  4 years ago

The whole garden is the weeds Diane w00t Na no really..
Its like a footie pitch back & front together..i said in above responses what happened on the phone, now i wait & see..even if it does work out in my favour.I
reckon a garden party is needed anyway hehe happy

myLot reputation of 96/100. cinderella2007 (1629)   ranked 271 out of 26,919 in people  4 years ago

Lets do a vote for having a garden party at LnP's!!! I think we should just have about enough people to help with the garden!!

If I live near you I would gladly rearrange your garden, so you wouldn't have to be charged for the state it is in now. But since you have only five days, and not me in the neighbourhood, I suggest you better think of something or get your garden gloves on.lol
Seriously, don't you have anyone to help you? Some guy in the suit? I am sure there are plenty of volunteers.wink

myLot reputation of 68/100. LoudnProud (6249)  4 years ago

I need a team of footballers to run about on it.Its about the size of a pitch haha.
yeh there are people who would help..but i hate asking people for help..To me that says..FAILURE !!
i wrote above what happened on phone & if that dont work out this afternoon i will do as Ellie suggested,so i dont feel so bad just asking,i will involve alcohol & food, that dont seem to bad eh noooo lol

I was going to ask why you still even have a garden after being there for so long but then it dawned on me that some words don't mean the same thing and you mean garden in the way most here would say it.

Maybe your stubborn? My word woman that is an understatement LOL. I would feel the same way about having to pay half the price of buying a lawn mower to get it fixed, knowing you will just be in the same situation again. I guess the real question is do you want to pay 60 or 100.

As someone who does have seizures I would say lying about such a thing will only come back to bite you in the butt. Only you can figure out if in the end it will be worth it though.

myLot reputation of 68/100. LoudnProud (6249)  4 years ago

Yeh a garden as in the area outside of my house..you know grass n stuff lol
I could get my lawnmower fixed for £60 but even then thats no good as it will need a more professional touch or more bodies to help, that would work yes but i cant keep askin people to help & i cant do it on my own everytime either, lawn mower or no lawn mower.
Your right about the seizures,he dont have them now, well maybe some of those day dream ones at times, hard to tell tho !
I will see what guy says later Raz..i will cry sad

angryMy Mom would be having fits about now! 2 Teenagers living in the house and no one is cutting the grass. Weeding the garden..

I would be rounding up those 2 young-ons, and saying that we need to get the yeard work done ASAP or we might get evicted.w00t I would scrap out the 3 broken lawn mowers. They dont work they aren't doing you any good just sitting there.

I think that handling the problem head on is the best action.happy

myLot reputation of 68/100. LoudnProud (6249)  4 years ago

I only have one lawn mower Louise, bought last summer. The rest were thrown away when they broke over the years. The one i have is broken too,i know i need to dump that too ha
Its too much work for kids, yes at one time they would have been able to do it,but I let it all go outa control
In previous years i have coped..just!
Think i will bomb it all w00t

Naw I wouldn't lie, I know you don't like liars. I would just tell the truth, that the garden is too much for you to handle as you have to help your dad so many days a week. Why do they have to know how many days you help him? If you want to play on anything play on the helpless female aspect. LOL!

I guess it is pretty simple. If you signed a lease that you agreed to maintain the gardens and mow all the lawns on the property, you simply have to do it or else they can do it and charge you for the work. End of story.

Fabrications, excuses and exaggerations will get you nowhere. If you don't have the time, you have to hire and pay someone to do it. Again, end of story.

I was a legal secretary for many years in the big city. I used to make up these leases as well as instruct people on how to enforce them. They are following all the right routes by notifying you in writing and giving you a deadline. They are well within their rights to go ahead and hire someone to do the work you are responsible for in your lease. And they are also well within their rights to bill you for it, as they have given you advance notice in writing. Verbal communication is almost useless as it has no paper trail, and no record and difficult to prove. That's why people put things in writing. To cover their butt and ensure there are no mis-communications.
