Bush vs. Gore Attorneys Sue to Halt Prop 8  |

| They were on opposite sides back in 2000 when Bush vs. Gore went to the U.S. Supreme Court; now they've teamed up and hope to end up before the Supremes again, this time in opposition to California's Prop. 8. http://cbs5.com/local/gay... Theodore Olson of Washington, D.C., and David Boies of Armonk, N.Y. are representing two gay couples in the federal suit which argues that Proposition 8 violates the U.S. constitutional guarantee of equal protection and due process. Olson, who was President Bush's Solicitor General during his first term, said he hopes the case goes all the way to the Supreme Court. A favorable ruling would mean same sex marriages would be legal in all states. Any thoughts? I say let's get it over with, let people marry who they want to marry and move on. | | Well, I've never pretended to be a lawyer or a Constitutional scholar but I think Ted Olson knows what he's talking about, he's argued before the Supreme Court over 50 times. I agree there should be a positive campaign but, in all fairness, have there been anymore incidents like the ones you mentioned and is it fair to judge the whole "movement" by the actions of a few extremists who have gone about it the wrong way? Equal means the same as everyone else. If my husband and I move to any state in the US we are husband and wife, what would happen to them? And would that be fair that they are considered married in one state but not another? Or what if one ends up in the hospital dying and they need the signiture of the spouse? It is a confusing thing but I think this has to be a federal thing for equal rights to work | | | |

| | I tend to think something this big should cover the whole country. If a citizen of the U.S. chooses to live in any of the 50 states their marriage should be recognized in all 50. I'm still unsure as to why the people who aren't directly affected should have the right to vote on it. Do you realize if it came up for a vote today there would still be some states where interracial marriage isn't allowed? I think this falls under equal protection under the law. I know I'll get slammed for this by some of you but I've heard people far more educated on the law and the Constitution than I am who have taken this position. | | In my opinion we don't need it interpreted. It's written at an 8th grade level, it ain't rocket science and if a dim-wit like me can understand it, ANYONE can. What we use the court for is interpreting laws and situations based on it. If you want to see this as accepted in all 50 states, then they propper way to do it is with a constitutional amendment, plain and simple. | | | |

| | I think state's rights are great but there are some things that should be uniform if we are to remain the UNITED States and not just 50 independent countries. There are times when people have little choice but to move from one state to another. Federal employees and members of the military would be two good examples. Would it be right for a couple to be married in one state and then have to move to a state where their marriage wouldn't be recognized and possibly they'd lose their benefits as a married couple? Also, how would the income tax laws go? As long as we have a FEDERAL government and a FEDERAL income tax the tax laws and benefits should be the same for all 50 states in my opinion. Annie | | | |

I think it stands to reason that if gays get married there will be some who want to get divorced. Why would they be any different from the rest of us in that way?
