| | Well, geez, the man was resisting arrest. So some force is necessary. The question is whether the force was excessive. Police dogs are trained to use their teeth to restrain an individual if necessary. The issue here is that the dog grabbed the wrong part of the body. Since there are no bones in the ear, only cartilage and tissue, the ear is more susceptible to damage. So I don't believe it's showing excessive force in my opinion. Also, since this was done by an animal, in the case of the lawsuit most likely the prosecution would have to show neglect either on the basis of insufficient training for the K-9 or malicious intent on the part of the police department. So, if there were any other instances of excessive abuse or violence on the dog's part that the police department was aware of, then maybe. Honestly, though, I don't see much of a case here. It would just be a lot of wasted time and money in my opinion. At least, that's what I know from US law, but I see this story takes place in the UK. So who know. | | | | | | |

Nowhere in my response to this discussion did I say there should be any leniency toward criminals. I was simply commenting on the legal matter at hand. In my own humble 'princess' opinion, if you screw up and get caught, it's your own dang fault and you should just deal with it. I know sometimes a lawsuit makes sense. That's why they're there. But really, it's bad. When I had a bad car wreck a while back, I got so many offers from lawyers to represent me. I'm just like, for what? That's what my insurance is for. And, like it said on the dang police report, I was not injured. So why in the heck would I want to sue the other guy when he already has a ticket and a spike in his insurance to worry about? Complete crap.
