U.S. Constution: No federal authority to impose a single-payer health system.  email this discussion to a friend?

According to the United States Constitution a president nor the United States congress legally can impose a single payer health care program on the people of the United States of American.
As well according to the United States Constitution our government cannot force a medical program upon any person of the United States legally.
The democrats health care bill speaks of imposing fines on employers and citizens that refuse to buy health insurance according to the U.S. Constitution that is an illegal act on the governments part.
If the democrats ram this bill through against the will of the people of the United States and President Obama signs it in to law won't they all be guilty of a serious crimes against the people of the United States of American?

Because the power to regulate each citizen's medical care is not included among enumerated powers, he said, the federal government does not have the authority to impose a single-payer system.

"You have to look to the Constitution and ask, 'Is health care listed?'" Boldin said. "No. It's not."

"Is health care directly necessary and proper to carrying out any of the listed powers such as creating post offices and national defense?"

He said critics might argue that to have a good national defense, the United States must make sure that everyone is healthy.

"But that would not fall under any definition of what's considered necessary and proper," he said.

Furthermore, he cited the 10th Amendment, which states:

The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

He said that while the government has overstepped its bounds in many cases and used the federal government in violation of the 10th Amendment, that provision must not be ignored.

"No one has ever repealed the 10th Amendment," he said. "They do it by judicial fiat, but it still exists."
'Equal Protection Clause' of 14th Amendment
The 14th Amendment states, "All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws."

Some proponents of federal health care have argued that every citizen must be treated equally, and the current health care system is an example of gross inequality that runs contrary to principles of the 14th Amendment. They say wealthy people are able to afford and obtain medical treatment while the less fortunate are left to suffer when they are unable to pay for an operation or treatment.

"That argument would lead to a crazy slope where you could say everyone should have the exact same car," Boldin said. "Then we should have the same guarantee of transportation to get to work, the same guarantee of food and shelter. Should we all have equal homes? I mean, if someone wants to make that argument, they have to make some serious changes to the Constitution to authorize it."

According the the US constitution you are not allowed to donate thousands of dollars to a candidates from a party, so you can then write an energy bill that makes you and your corporation millions (http://www.citizen.org/cm...) But, that happened.

Well, this is the bwsic point that people refuse to acknowledge - the government keeps trying to run business instead of attending to the business of government.

Taking over businesses, regulating compensation to American workers, mandating what income people may make - none of this is constitutional. I realize that government has been slowly eroding our rights and taking more power for itself for decades but that doesn't make it right.

Sometimes it takes something as huge as this health care reform bill to get people to wake up to the reality of what is going on at the federal level. They rightly stand up to be heard and counted and find out that they never really had a voice all along, their Congress and their president are not listening, and they will not comply with the will of the people.

It's a wake up call to the American people, and time is running out to put things right. But the genie of government control is out of the bottle and it's going to be one heckuva fight to get it back in again.

It doesn't mention medicare, social security, grants for research, or any other of the millions of programs designed to provide opportunity and promote a standard of living either. So what?

The Constitution can and has been amended- sounds like WND and Boldin are just nitpicking. Again.

A single-payer health system isn't even being discussed at this time although we've had Medicare for years and that's exactly what that is. Would you be willing to give up YOUR Medicare, Rose? I know my mother would have lived fewer years by far if she hadn't had Medicare. Of course there's nothing about health care in our Constitution but what kind of health care even existed over 200 years ago?

I'm not on medicare,Far as medicare I think employees pay in to medicare and social security most workers for most all of their working year's.
The fore fathers had wisdom to see ahead that is why the United States Constitution clearly state government should not man date health care nor pass laws to be the payer of health care,nor force citizens in to a one size fits all health care system.
This currant bill states employers that do not have employee health insurance will be fined 8% of their pay roll,people that refuse to buy insurance or go on the government run health care as well will be fined, bottom line what is being done or attempting to be done is unconstitutional and illegal,taking the rights and freedom away from American citizens.
Americans that don't care about such thing's have a right to be agreeable but others that do care about their personal right's and freedom do have that same right.
Last I cheack 54% of the American people are not in favor of H.R. 3200.
Thanks for your input I understand you badly need health care and like many other people that need to have some health care are in favored of H.R. 3200 but the people that will be forced to pay for it and theirs taken away at some point in time are not in favor of this bill.

Rose, I have good health insurance so I'm not worried about myself. I happen to feel some compassion for those who aren't so fortunate. Our founding fathers couldn't have possibly foreseen the current health care crisis and it's not clearly stated in the Constitution because they couldn't have known the medical advances we've had or how much it costs. Could I ask you one final time why you keep saying they want to take your health insurance away and give it to someone else?
