| MANY DON'T SEEM TO BELIEVE THE UNITED STATES CONSTITUTION IS ANY LONGER IN EFFECT AND HAS BEEN DISMISSED AS OUT DATED BY THE U.S.GOVERNMENT INCLUDING THE HIGHER AND LOWER COURTS OF THE UNITED STATES. IT APPEARS HILLARY CLINTON WAS APPOINTED SECTARY OF STATE BY BARACK OBAMA ILLEGALLY READ THE ARTICLE FOR THE LEGAL DETAILS AT THE LINK BELOW,LEAVE YOUR COMMENT IF YOU HAVE ONE ~ ~ ~ (HILLARY CLINTON ILLEGALLY APPOINTED BY BARACK OBAMA) A State Department employee has filed a lawsuit today in federal court against newly sworn-in Secretary of State Hillary Clinton claiming she is constitutionally ineligible to serve. Judicial Watch, a public interest group that investigates and prosecutes government corruption, announced today that it is pursuing the complaint in U.S. District Court in Washington, D.C, on behalf of U.S. Foreign Service Officer and State Department employee David C. Rodearmel. Rodearmel, a resident of Virginia, maintains Clinton is constitutionally ineligible to serve as secretary of state and that he cannot serve under her because doing so would go against the oath he took as a foreign service officer in 1991 to "support and defend" and "bear true faith and allegiance" to the Constitution of the United States. "This is not a partisan, political or personal issue," Rodearmel said in a statement. "I have faithfully served under six prior Secretaries of State of both parties, and under eight Presidents since first taking the oath to uphold the Constitution as a young Army officer cadet. … As a commissioned State Department Foreign Service Officer, a retired Army Reserve Judge Advocate Officer, and as a lawyer, I consider it my Constitutional duty to bring this case to the courts." The constitutional quandary arises from a clause that forbids members of the Senate from being appointed to civil office, such as the secretary of state, if the "emoluments," or salary and benefits, of the office were increased during the senator's term. http://www.wnd.com/index.php?pageId=87451 | | | | | |

| | This issue came up when Clinton was appointed but then seemed to fade into obscurity. Unless someone keeps these issues before the public, they get forgotten as the White House refuses to respond or acknowledge any call for this administration to follow the Constitutional. | | | | | | |

| | I thought they had already gotten around this by lowering her salary or someone's salary. lol I'm surprised to see another article about it. | | | | | | |

| | The article you linked to was posted on Jan. 30, nearly 10 months ago!! This is certainly VERY old news and has long since been resolved. Also, Hillary wasn't the first person to be affected by this rule. One more thing, there was nothing about this lawsuit going to the U.S. Supreme Court. "Federal Court" and the "Supreme Court" aren't the same thing; the Supreme Court is pretty picky about the cases it hears and I doubt it would be bothered with this kind of partisan nitpicking. I think Hillary has been doing a fine job as Secretary of State, by the way. Annie | | | | | | |

| | Well Hillary will do her best to sort it out because she won't want anything like this coming up when she runs for President in the next Presidential election and believe me thats what she will do. | | | | | | |

| | Well, she's said she has no intentions of ever running for anything again. It woud take a heck of a lot for her to run against an incumbent President from her own pparty, never mind that she's part of his Administration, in 2012 and 2016 is a long ways away. Annie | | | |

| | According to the polls, a large number of voters - including independents and conservatives - would rather have had Hillary now that they've seen Obama. I think she should give the next election a shot. | | | |

| | This sounds like a very cool legal issue that may get the courts attention. It will be interesting to see what happens. One strategy for Obama is to retaliate against the plaintiff and drag the litigation on until he leaves office. Hilliary leave her Secretary of State Office if she decides to run for office such as President | | | | | | |

| | Doesn't really matter.. by the time it gets through our wonderful court system... she'll have moved on to something else and the whole thing will be null and void. Shame to think that a salary is what is determining things like this. Ability doesn't seem to be in the mix! | | | | | | |
