My Rant: Social Security email this discussion to a friend?

myLot reputation of 97/100. wellamoose (1144)3 years ago

OK, this might be a little long because I'm pretty P.O.ed. So, here we go... My husband is disabled. He has several health issues that have made it impossible for him to work. He filed a Social Security disablity claim 4 years ago. He was denied 3 times, so we decided to contact an attorney. He was denied once with the attorney, but then they finally sent him to one of their independent doctors. My husband has severe asthma and coughs a lot. Their doctor wouldn't even see my husband unless he and the doctor both wore a mask. The doctor also instructed his nurse to spray Lysol everywhere my husband had been. The doctor basically said that he was disabled and we figured that would be the end and he'd be getting benefits. NO! He was denied again! The attorney filed another appeal and my husband was finally granted a hearing in December 2005. It turns out that the reason he was denied after he saw the doctor was because a "vocational specialist", who had never even met my husband, told them that he was able to work. At the hearing, however, after this jerk finally actually met my husband, he said,"Oops, I was wrong". My husband won his case over a year ago. As soon as the hearing was over, his attorney told him that he had filed papers to get the settlement to go back to when my husband first filed, in 2003. We finally got a letter this past December telling us that everything was "fully favorable" and he would be receiving payment within 60 days. He had an interview at our local office in January so they could work out his payment schedule and take some more info. They're adding some money onto his check every month for my kids because we don't receive child support for them. OK, so it's been almost 90 days, and still nothing. He called a couple of weeks ago and asked what was going on and they said that they were still working on it and he would definately have it by the end of February. Well, here it is, March, and still nothing. He doesn't want to call and find out WTF, but it's getting really frustrating! He's getting Supplemental Security Income, which is $770 a month. They keep telling him that he shouldn't be so worried about it because he's already getting a lot of money! His SSD benefits are about $1100 more than that a month! We are barely able to pay our bills and stuff right now. I'm working and up until last year, I was working 2 jobs to keep us going. I had to quit the second job for various reasons I won't get into here. On the 10th, it will be 45 days since his interview. The creditors who keep calling don't believe us when we tell them that it has taken over 4 years and we still don't have the money. Everyone thinks that we're liars because nobody has ever heard of it taking this long! We are both really depressed because things are breaking around the house and we don't have the money to get them fixed. We have a car only because my dad bought a new one and gave us his old one. If I didn't have my dad, I wouldn't have a job! Has anyone else has this much trouble? Have you ever heard of it taking this long? Any input is welcomed. Thanks!

Sorry, you are having so much trouble. I would contact the lawyer that handled the case and clue him in. It should not take that long. If you owed them money, they would not wait. We have a very unfair system. It is like they think that people are not important. I would call them 3 times a week until I start getting it. They will get tired of hearing from you and just might get that check in the mail, just so you'll leave them alone.

The lawyer already knows that Social Security is dragging their feet. They haven't been paid either, but it's in the payment processing center in Baltimore, so there's not much the lawyer can do. As for calling all the time, we've tried that and it didn't work very well. As a matter of fact, the person who was supposed to be my husband's case worker got so sick of him calling, that she refused to be his worker. Also, he has to give his name and social security number at the start of each call and they just end up "accidently" disconnecting his call. They don't really care about people. Why should they? They're getting paid, who cares about anyone else. We just keep hoping and praying that it'll come soon. Thanks for your response.

Sadly I have but usually only here in Florida. We have a high amount of people applying for Social Security here and they automatically deny everyone as long as they can. My sister is going on three years since she applied. She's to go to a judge soon but they said that can take up to another year until the case is even heard. It's crazy and then they will only give her back benefits for 2 years, it used to be from when you first applied. I need to apply (numerous health reasons but too long to get into here) but because we live together I don't want to do anything that could mess up hers and with my luck and hers if I did it would mess it up. Some red flag would go up and delay it even longer then it already is. If it wasn't for our mother helping us out we would be on the streets. I know they have to be careful due to so many trying to scam them but they go a bit over board on it. All the stress for this has caused my sister to have one heart attack (she's only 42). At least you have had your day in court and they are going to pay...eventually. Right now we are still in limbo and I'm sure you know how miserable that is. Just know you aren't alone in how long it does take to get them to actually do their jobs correctly.

I definately know what you are going through. Do you have an attorney? We had to get one and many people do because unless you have an attorney, social security won't even bother with you. The other thing that is slowing our case down is that my husband doesn't have a firm diagnosis. The doctors don't really know what is wrong with him. They thought a couple of years ago that he had ALS, but he doesn't. He has a lot of things, but not one thing that they can say definatively. The other thing is, make sure your doctor signs the paperwork properly. The first few times, his doctor said his prognosis was good as long as he stayed on his meds. His prognosis meaning in her opinion that he wouldn't die. He will never get better though. So, his prognosis is not good. Sometimes doctors can be really stupid! I hope your cases go well for you both and you won't have to wait too much longer. I wish you both the best of luck!

Thanks:)

Yes my sister has a lawyer not that he's done all that much. The doctors thankfully have all done things right. Even Social security came back with a letter saying she was disabled, just not disabled enough because she could still work. Yeah right. She's on dilaudid (spelling) 4 times a day, what place is going to hire her with that in her system? They are crazy with what they do with things. I know when I go to apply the problem I'm going to have is that most of my records are too old. I don't have medical insurance so trying to get new ones are a bit hard, no money for it. Hopefully though once I go to apply I can get medicaid so I can get new ones. How they expect you to have all these doctors and medical treatments for them to check out when you don't have money or insurance is beyond me. Only reason my sister had all hers was hers was a workman's comp injury so they paid for all the treatments for two years. our system really is messed up at times.

The people who work for social security are all a bunch of liars and cheats. They tell you something and they are just lying about it. They lie to the lawyers and the client. I wish there was a way to sue them. I am Wella's Husband so I am the person she was reffering to. Well! I just got off the phone with my worker and she said she was waiting for her supervissor to sign a paper that she filled out to send to me and that I should be receiving it in a couple of days. Yah! Right! I have heard that a hundred times before. I hope that every one of them that handled my case becomes disabled and gets the same treatment that they gave me.

We have an update. We received a call and a letter from Social Security and my benifits well start on April 1st. They still are holding the settlement amount because the are still trying to figure out how much they owe me and how fro back to go (from my original filing date of January 2003, the year before that as to when I was haveing major dificults working or when the lawyer refiled for me in April 2004). And get this - they admit that they did not process this in a timely manner. They are admitting that they have done something wrong.

myLot reputation of 97/100. wellamoose (1144)  3 years ago

Well, here we are at the end of March, and still no money! They told us that we would have it by the end of February, but no. They told us 3 weeks ago that the check was in the mail and that we should expect it any day. Still nothing. I wish they would be honest. I mean, I wish they would have told us that we weren't getting anything. At least then we wouldn't keep expecting it only to be disappointed AGAIN! It's extrememly frustrating and it's depressing. We're supposed to at least start getting his benefits on the 3rd of April, if they haven't lied to us yet again. I guess we'll see.

Well, I can defenatly relate to what you are going through. I too am disabled and have been for over 20 years. It took me 7 years to get my social security so I have been there too and indeed know what you are going through. It does take about 90 days from the time you had your interview to recieve anything I think. They are vey slow, it is a process that they go through.

Since you have been following my SSI disability fiasco...thought I'd put some input here...Now because of what I've been going through with my own problems with SSI benefits so many people have suggested I go through the lawyer routine.....to be honest yes, lawyers can probably help,...but you have to remember...the longer a case goes and lingers on the more a lawyer will get..lawyers actually like to stretch cases longer...how do I know this.....a friend of mine went through a lot of hardships to get her disability as well..she was denied repeatedly....it took her nine...yes nine years to finally get her benefits!!
If you been following my situation which you have...I got in contact with my Congressman...yes...get a person IN the government with clout...when I recently e-mailed my Congressman I got a response the next day! I was to expect a phone call from a representative of his office on Monday (May 21)--and I did...she told me to fax a letter to her authorizing that they could intervene in my case..plus fax over the letters that denied my benefits plus the letter I had gotten stating that I OWED them money...I did that...when I got home after faxing all this stuff, I called the woman back at the Congressman's office...not only had she already gotten my faxed material she had already called Social Security....she said I should give it another few days to a week and this might be settled...she gave me hope...and maybe because Social Security got a phone call from a representative of a Congressman the jerks at SS know I MEAN business..
So bottom line if you're still having problems..get in touch with a Congressman or other high government official--I'm hoping my case will go faster now...and maybe with someone to back you up as well,..you can get all that you deserve too

I am first off so sorry to hear about your situation and I will keep you in my thoughts. I had a similar situation, one of my daughters is both mentally and physically disabled and were denied benifits the first time, but I went to the state and they had a representative help me. They got all her doctors records and had more tests done and she was approved but she went with me when I was interviewed I think that may have helped.

Take Care, I hope things get better for you.
