Received this 'info' in an email today and wanted to share it with you all. It's time again for the annual 'Stella Awards'! For those unfamiliar with these awards, they are named after 81-year-old Stella Liebeck who spilled hot coffee on herself and successfully sued the McDonald's in New Mexico where she purchased the coffee. You remember, she took the lid off the coffee and put it between her knees while she was driving. Who would ever think one could get burned doing that, right? That's right; these are awards for the most outlandish lawsuits and verdicts in the U.S. Here are the Stella's for the past year: 7TH PLACE: Kathleen Robertson of Austin, Texas was awarded $80,000 by a jury of her peers after breaking her ankle tripping over a toddler who was running inside a furniture store. The store owners were understandably surprised by the verdict, considering the running toddler was her own son. 6TH PLACE: Carl Truman, 19, of Los Angeles, California won $74,000 plus medical expenses when his neighbor ran over his hand with a Honda Accord. Truman apparently didn't notice there was someone at the wheel of the car when he was trying to steal his neighbor's hubcaps 5TH PLACE: Terrence Dickson, of Bristol, Pennsylvania, who was leaving a house he had just burglarized by way of the garage. Unfortunately for Dickson, the automatic garage door opener malfunctioned and he could not get the garage door to open. Worse, he couldn't re-enter the house because the door connecting the garage to the house locked when Dickson pulled it shut. Forced to sit for eight, count 'em, EIGHT, days on a case of Pepsi and a large bag of dry dog food, he sued the homeowner's insurance company claiming undue mental Anguish. Amazingly, the jury said the insurance company must pay Dickson $500,000 for his anguish. We should all have this kind of anguish. Keep scratching. There are more... 4TH PLACE: Jerry Williams, of Little Rock , Arkansas , garnered 4th Place in the Stella's when he was awarded $14,500 plus medical expenses after being bitten on the butt by his next door neighbor's beagle - even though the beagle was on a chain in its owner's fenced yard.. Williams did not get as much as he asked for because the jury believed the beagle might have been provoked at the time of the butt bite because Williams had climbed over the fence into the yard and repeatedly shot the dog with a pellet gun. 3RD PLACE: Amber Carson of Lancaster, Pennsylvania because a jury ordered a Philadelphia restaurant to pay her $113,500 after she slipped on a spilled soft drink and broke her tailbone. The reason the soft drink was on the floor: Ms. Carson had thrown it at her boyfriend 30 seconds earlier during an argument. What ever happened to people being responsible for their own actions? 2ND PLACE: Kara Walton, of Claymont, Delaware sued the owner of a night club in a nearby city because she fell from the bathroom window to the floor, knocking out her two front teeth. Even though Ms. Walton was trying to sneak through the ladies room window to avoid paying the $3.50 cover charge, the jury said the night club had to pay her $12,000....oh, yeah, plus dental expenses. Go figure. 1ST PLACE: (May I have a fanfare played on 50 kazoos please) This year's runaway First Place Stella Award winner was Mrs. Merv Grazinski, of Oklahoma City, Oklahoma, who purchased a new 32-foot Winnebago motor home. On her first trip home, from an OU football game, having driven on to the freeway, she set the cruise control at 70 mph and calmly left the driver's seat to go to the back of the Winnebago to make herself a sandwich. Not surprisingly, the motor home left the freeway, crashed and overturned. Also not surprisingly, Mrs. Grazinski sued Winnebago for not putting in the owner's manual that she couldn't actually leave the driver's seat while the cruise control was set. The Oklahoma jury awarded her, are you sitting down, $1,750,000 PLUS a new motor home. Winnebago actually changed their manuals as a result of this suit, just in case Mrs. Grazinski has any relatives who might also buy a motor home. Have you or anyone you know ever sued someone or been sued? Why not share with us here...we will give our opinion. --------------------------------------------------------------------------------

Hi Ms Tickle! I really pity those business owners who have to deal with these kind of people. I really wonder what is running in the minds of the jurors and the judge who have awarded all those people with money that they don't deserve at all. Really funny and weird. Take care and God Bless!

These examples of frivolous lawsuits are an example of how lacking our judicial system is and I expect the "victims" and their lawyers are laughing all the way to the bank.

While these are humorous anecdotes, you are quite right in what you say. There are many cases of actual lawsuits which are indeed a waste of time and money. There was a guy in Australia at a party. He decided to jump over the back fence into the canal. He came a cropper and ended up a paraplegic and sued the home owner saying there should have been a sign saying "Do not jump the fence into the canal". He won. The home owner subsequently appealed the stupidity of the outcome and the "victim" ... he won his appeal.

Oh my goodness, I don't see how these people were rewarded for all these accidents when all of them were their own fault. They must have either bribes he judge and jury or had one heck of a lawyer. That is like the man sued a woman for $10,000 plus medical expenses, for breaking into her house and actually sueing her because he got cut on glass and had to get stitches..now remember he broke in with the intent to rob her blind and did take some things but didn't get to finish the job because he was bleeding to bad, and decided to go to the hospital. Talk about crazy.

These are not real examples of ridiculous claims. Which is not to say they don't actually happen.

The above examples are frivolous examples of humour but there are indeed some equally frivolous real claims. Were they your trees? That sounds absurd...

Heaven help us! No wonder this country is going down the tubes. We have such stupid judges that will let lawyers bring such frivolous cases into their courts. And then we have the jurors who probably wish they were the ones on the other side of the case receiving all this money. In other words, they are setting a precedent in case it ever happens to them. I thought the case at McDonald's was the stupidest case ever won! The woman deserved to be burned for doing such a stupid thing, but she did not deserve to rob McDonald's of money which is what happened. Pure robbery. But now, the Winnebago deal takes the cake. How can some people be so naive? Do we have to have everything written down in English? Can people NOT think for themselves anymore? Thanks to the Stella awards, all these cases are being recognized for what they really are - stupid decisions made by jurors that shouldn't be on the case in the first place. And an award should be given to ALL the judges who let these cases even come to their courts. They are the ones that really are to blame for all this money changing hands. I'd like to see them all overturned!

While these cases are fictitious, there are real cases out there that defy common sense. I've noted a few actual cases on the previous page and one of the other members also posts a similarly stupid case.

There are stupid cases being filed every day! And, here I was the recipient of an accident which made me have to have a full hip replacement in Shoney's, and they had the gall to tell me they weren't responsible! I didn't sue because of being out of state (11 hours away) and my lawyer would have had to get a lawyer there to represent my case and the expected outcome wasn't all that good, money wise. The lawyer would have gotten most of a small thing. So we decided not to try. It was too much of a hassle. It infuriates me that it is so easy for these frivolous cases to get to court and win and someone with a legitimate claim has a problem even suing!

http://www.snopes.com/legal/lawsuits.asp Aww. According to Snopes, these simply aren't true, and have been doing the rounds in Email since 2001. Shame, really, because they are amusing.

While these are not true, Snopes does list some equally frivolous lawsuits in the same article that are for real!

This is amazing how these people can sue when they deserved just what they got...Each case seems as though they brought it on themselves.I do not understand how people can sue and actually get money for their own mistakes...I thought the one about the woman tripping over the child in the store was ok,until i read it was her own child..Haha Maybe we need to just start sueing Haha........

So true! While these cases are not real, there are actual cases which are similar. Several years ago while I was working interstate as a checkout chick in a large supermarket there was an incidence of a woman, her child and a trolley. The woman tried to sue the supermarket chain because the child rammed her or someone (can't remember the details). The judge said the staff should have stepped in when the child was misusing the stores equipment. I don't think he awarded the case to the woman though. The result was that we were given permission to speak out to the customers if a situation looked like it could become dangerous if a child was misbehaving. Of course, we all felt ...right! like the mother is going to take that sitting down! I had one guy who's two kids were running in and out of the checkout and climbing on the packing bench. I said he shouldn't let them do that as they might fall. He said it was easier to let them do what they want. The littler kid fell down and I got a look as if to say it was MY fault!!

There are people out there that are just looking for a way to have a law suit, and that is sad...Don't get me wrong,if a person is actually hurt, and not their fault then i think it is fine to sue for your real medical problems, and thats ok..These people that go around looking for the least little thing so they can sue, that goes against everyone of us.It makes insurance go sky high, and as it stands we all have to pay a high price for these false lawsuits...

Isn't it incomprehensible that such people would not only not be charged but that they would even think of suing? I cannot understand how any of these were not laughed out of court. Not only is this world going mad but its legal system is leading the way to the lunatic asylum! xxx

These situations are false Mo. But there is some weird stuff that happens. At the moment there is a nut case at large...a convicted paedophile who has re-offended. The judge threw his case out because he deemed the guy would not receive a fair trial. Hundreds of thousands of dollars have been spent to house this guy because he keeps getting harassed whenever he moves into a neighbourhood. The public are outraged and there have been street protests and public forums because no-one wants him living in their neighbourhood.

I think that while these inconsiderate people get rich off these lawsuits the rest of us have our insurance rates increase every year because the insurance companies are not going to go broke. I don't like seeing people that live in a irresponsible manner be rewarded. It has gotten so you don't dare to be friendly to anyone anymore and I don't open my door to people like I used to for fear of being sued for some stupid thing! If this keeps up we will be locked in individual cocoons with no public places ...no-one will be rich enough to afford the insurance rates! It needs to stop! Oh and one last think who will be complaining when we have to get a special licence( will cost for it too) to drive a motor home because of morons like Grazinski!Pleaseeeeeeeeee xoxoxoxoxoxo

Hi Doll! While these cases are fictitious, there are actual cases of people behaving stupidly and someone else paying the price...it's appalling! On the other hand, I actually believe there should be a requirement for people to attain an education in the use of 4 wheel drive vehicles, towing a van and the driving of motor homes. Not a license, perhaps, but definitely a certificate of competency. There is a large increase of accidents involving 4 wheel drives in Australia. A lot of suburbanites have them with no intention of ever going off-road. They drive them like tanks!
