Have you dealt with Workmans Comp?

Hi all, I am so very frustrated it has been 3 months and I am still out of work. I had an accident while working and now workers comp just insists on telling my doctor what I need or do not need. When I went to the doctors she had checked me out and said that I had some red flags for a herniated disc in my lower back from the accident. At this time she requested an MRI which workers comp denied. (uggg) She put in again stating she would not allow me to go back to work until an MRI was done. Their response was so keep her out. They have allowed 24 visits so far for physical therapy which helps for a shot period of time. My upper back muscles have taken on alot of stress and my doctor insists that it is from the accident. My upper back neck head and arms has a tingling sensation all the time which is very painful. It feels like when you have a sunburn and a cool breeze comes by. To wear a shirt hurts my skin. She put in for PT and they refuse that too. My goal is to get back to work I just want to know what is wrong with me, my doctor is concerned for the simple fact the pain seems to be spreading every where, some days I feel like a Big Truck has hit me. The part that gets me is that they are sitting behind a desk and making the decisions while my doctor is the one that sees me in such pain. To me this is nothing but medical neglect on the part of workers comp. I do have a third party lawsuit and tried to get the MRI through my private insurance but workers comp said if I did this I would lose my monetary benefits. Talk about being caught between a rock and a hard place. I have been a prisoner of my home for 3 months. I can not sit stand lay down for any length of time. My sleeping is so out of whack it isnt funny, up for 30 hours sleep for 4, up another 24 sleep for 2. How much is one suppose to endure? Every way I turn I get shut down. Is it so wrong for me to want to get better, it should be thier responsibility to make sure they are not making things worse. I even asked to see one of thier doctors and they said there was no reason for this. I have anxiety attacks. I feel depression hitting and everything effects my whole family. I try to go out on rides to the beach with my family and the ride in itself makes me very sore. Have you ever had to deal with workers comp? I would love to hear how they treat other people! Can you tell me what my next move should be?

I have been off work for 4 months due to an injury to my left wrist/hand, I'm a wildland firefighter and lifting 50 lbs plus is an everyday occurance, also working on wildland fires I need both hands. When it happened I was going to continue to work, best I could, but my boss came to me and told me they were putting me on medical leave. I had never before dealt with workman's comp, so I knew nothing of how it worked. I did take the necessary protocol concerning my injury, I notified my supervisor, and the dist. office as to what had happened. I did start out seeing a panel doctor from our list of doctors, I have had xrays, MRI, MRA, and now seeing an orthapedic specialist, and starting therapy. I have submitted the necessary paper work from each and every doctor visit, and I have stayed in touch with my case worker for workman's comp. I guess I am lucky after reading your situation. They began my compensation payments on time, they have never denied any diagnostic tests, or therapy that the doctors have ordered. I am able to call and talk to the person taking care of my case anyday of the week. I do know that I made sure I reported my injury as soon as I was able to get a call into the office, and went straight from work (some 7 hours after it happened) to the emergency room to have it checked out. The person who submits this information on to our HR and in turn workmans comp. are very punctual in getting the paper work done. Other than going forward with the lawyer, I'm not sure what else you can do. I do hope you have all paper work and documentation from every doctor's visit, prescription, therapy, etc. that will help your case. Good Luck.
