The real question here is should the Environmental Protection Agency be able to regulate carbon and other greenhouse gases under the federal Clean Air Act? The Republican Senators and four Democrats are proposing that no they can not. Obama would be advised to veto the bill, it would "undermine the administration's efforts to reduce the negative impacts of pollution and the risks associated with environmental catastrophes, like the ongoing BP oil spill." Senator Murkowski says it comes down to who sets policy Congress or the EPA, I always thought it was Congress. Article 1, Section 8: "The Congress shall have Power To lay and collect Taxes, Duties, Imposts and Excises to pay the Debts and provide for the common Defence and general Welfare of the United States;" "To regulate Commerce with foreign Nations, and other several States, and with the Indian Tribes;" Soooo...Only Congress can tax or regulate, otherwise it would be unconstitutional? Interesting... Meh, that Constitution only reflects the times in which it was written. No need to follow it, right?

Congress should be establishing environmental law...not the EPA through its regulations. This EPA/Administration is going too far, and when it's reigns finally get jerked, I hope it gets knocked on its butt. Right now, I think the EPA is out-of-control and will probably remain so as long as this President is president.
