Flag is too big and too noisy

A Marine Veteran is going to court over flying the American flag. The HOA wants ten dollars a day for every day the flag flies, and a court order to remove it. HOA rules say you can have a six foot flag pole attached to your house. He has a twenty foot stand along flag pole where he flies the US flag and the Marine Corp flag.

Unfortunately, the HOA will most likely win.
In my opinion, the HOA should have just sucked it up and let him fly his flags.

I don't really see why the HOA has a problem. I mean, I can see why there should be rules, because otherwise, people could do all sorts of loud or disturbing things, but I don't see why there is a rule against flags.

My advice to the HOA is this: If it's too noisy, wear ear plugs.

i'd let him fly it.
it's probably one of those things they implemented to keep other people from erecting huge obnoxious displays of things.i'd tell him to ground the thing tho before it gets hit by lightning.

Hmmm. Is this about patriotism or flounting the law? My inclination is to say that why the heck shouldn't he fly the National Flag outside of his house. But there comes a point where you have to draw the line. Non-conformity is always hard on conformists but they do sometimes have a point. His comments about having been in the Service are frankly insulting to others who have not. Does being a military man or woman make you more or less of a patriot? At least he can fly the flag. Here we can only fly one on certain days. People have been prosecuted for doing differently!

At first I agreed with you, but under the 2005 Law, the Marine Veteran might win... The HOA needs to communicate with its membership to revise its agreement. That's what I'd do if I was an officer of the Home Owners Association. I think the HOA is taking it too far and needs to look for resolution of this and possible future issues.

I think that I would get another flag to fly with it. The other flag would say: If you can read this, thank a teacher. Since you are reading it in English, thank a veteran. I would make it the size that the HOA dictates, and DARE THEM TO TAKE IT DOWN.

When will the HOAs learn that they never win these cases? Even if they "win" the court case, they lose in bad publicity and public scorn.

Hiya laglen,
I hope he got to fly his Flag after all. What harm is he doing to anyone? If anyone wants to fly their own Flag as long as they don´t provoke anyone I think that they do no harm.
I hope that they came to their senses and let him fly his Flag without any problems. I have read the issue and unless there is something I am missing I cannot see what harm he can do in particular.

See what you mean. I don´t think that if the Flag is a moderate size and not too high so as everyone can see it and be offended that it should be a problem anywhere. Looks like the best place would be indoors hanging over his Fireplace the Flag I mean of course.
Then he could have all the Flags he wanted to his Hearts content and no one has to know anything about it except if they visit him a lot of course.
That way he would be defending the Flag and not upsetting anyone at all.
Of course he probably does not see it that way at all I should imagine.

Me again,
I seem to have overlooked that the Flagpole was a bit too high. But if he made a shorter one that would do surely and if he did not fly it all the time I still cannot see who is going to take much notice really except himself. That over here would definitely not go down well at all. As where I live is an area where there are strong oppositions to the Spanish Government itself. So that would be out of the question.
The conflict that they have where I live is long standing and goes back many centuries so I don´t want to bore anyone to tears with that story. It´s okay for them to have all their Flags flying but anyone else´s forget it.
