Realizing I've been wrong about the border fence issue.

Yup, you read it right, I was wrong about the border fence issue. I'm among those who have been calling for a border fence. But I have had to change my mind, because there is nothing in the US Constitution granting the federal government the authority to require any state have a fence on its state line... not even when that state line doubles as a national border.
There are only two provisions in the US Constitution that cover the illegal alien problem. Interstate Commerce and the "Rule of Naturalization Clause.
The "rule of naturalization" clause grants the federal government the authority to set the rules for immigration and naturalization. Using that clause, the government can make laws concerning the employment status of immigrants. Illegal aliens can be classified as "illegal to hire". For that matter, the federal government could also withhold grants and other federal subsidies from any organization or institution that receives them, and hires illegal aliens.
Of course, any company that does business in more than one state could also be held responsible for hiring illegal aliens.
Now, the onus is still on the courts to prove a company or institution is employing illegal aliens. We don't want to perpetuate the growing problem of "guilty to proven innocent".

I know adn I just found out the passed year or 2 that English isnt official langauge but for 71 years I thought it was! and It really gets my hair up when these people talk thier language with me standing there know ing I dont understand they might be saying something bad about me or our country I think this is very rude.
My daughter inlaw speaks very little English even tho we have worked with her for a few years now . SHe told my son tht we should learn her language she talks so fast I havent heard a work that I do know from school lessons. My grandson speaks both so does my son.
We will continue to work with her so she can learn

English may not be the official language of the United States, but it is the language of the American Dream. Anyone who discourages immigrants from learning English is working to hold that person down.

There is nothing stating that they cannot have a "fence" either. I do not think that they have to have an actual solid wall. A 'Virtual" fence would suffice. With all of the high tech surveillance equipment available today, I see no reason why they cannot accomplish it with that.

No, the US Constitution reserves everything not mentioned in it to the States and to the people.
There are no provisions in the US Constitution allowing the federal government to require any state to put up a fence on any of its borders.
So any fence on the border of a state is up to the states themselves.

RE - the Border Fence - who says the states "don't" want one. Texas and Arizona both want the border fences and Arizona passed a law letting the state raise money for and install the fence where the federalgovernment s too cheap or too slow to get the job done. New Mexico is starting to realize what a problem the illegla immigrants are and is currently working on (finaly) restricting drivers licenses to people who are legally in the state -so, I am not positive if they are for or against a fence. California - your guess is as good as mine on where they stand on the issue.
Comapnies employing illegal immigrants - pretty clear cut - you arrest a illegal immigrant and he has a pay stub from the company showing they paid him to work there - it is obvious they did emply that person. But, most of the laws being passed are for KNOWINGLY employing illegal immigrants - most of them are providing their employers with the requested documents (even if they are fake or stolen). Proving the company knowingly hired illegal immigrants is a lot more difficult.

Speakeasy, that's the thing, if they want one it is completely in their rights to build one. I'm just saying that the US Constitution doesn't authorize the federal government to build one.
Yes, it has to be for knowingly employing illegal aliens. We don't want it to become just another way for the federal government to randomly come down on a company.
