Why She Did What She Did.

Was the judge right to let her off with just a warning or should she have been fined? They say the customer is always right . Right? But that is not always the case, however two wrongs don't make it right. The situation unfolded at a fast food restaurant last week. It seems the customer was upset about the length of time it was taking for her order to arrive and was complaining loudly while waiting. Her order finally arrived , but that was not the end of it. She continued verbally abusing the server and threw her ticket at her. The server ( who l should point out is in an advanced state of pregnancy) retaliated by throwing the customer's drink in her face. She was taken to court on assault charges and when asked by the judge why she did it. Her reply was she was upset by the customer's verbal abuse, and the woman also threatened to ' poke her in the eye'. There were no witnesses in court and the complainant herself did not show up. So l suppose that could be the reason she was let off with a warning. Maybe both ladies were just having a bad day. I am wondering if the matter should have gone to court in the first place. What would you have done if you were that customer? How do you react when you experience bad customer service?

That is really poor behaviour on both accounts. The server should have left and found another employee to tend to that woman.

@Kandae11 We did tell the people up front why we were leaving. I heard that they told the boss and they felt bad about what happened. At least, the people in charge said there will be some extra training going on.

The server was in the wrong. As a server, she should have turned away and left the woman to her tirade. I think it was the right decision from the judge. The server will remember the episode for the rest of her life with regrets. She could have lost her job over her reaction to the customer.

I agree with you. I believe when we find ourselves in certain situations we should count to 10 before taking action.

This matter surely should have not gone to court, wasted taxpayers money. Those women were both wrong, I suppose a manager should have stepped in to fix the problem.

@Kandae11 - Exactly and the same had to do the client. If she was not satisfied she had to ask to talk to a supervisor.

That is what the judge told her. She should have talked to the supervisor or manager instead of throwing the drink.

I dont' think it should have gone to court but I think the manager of the fast food place should have stepped in and stopped it all before it got out of hand.

@Kandae11 i do agree that it was all probably a reflex action to throw the drink but it really could have escalated into dire consequences.

The server then should have taken the matter to the manager before doing what she did. Sometimes when people do things to you there is a quick reflex action without considering the consequences. The ticket was thrown at her and she retaliated by throwing the drink, which probably got into the woman's eyes and soiled her clothes too. Now imagine if that customer had continued by throwing something back at the server.....

Wow! That's a good case for Judge Judy, lol. Well, no assault charges should not have been filed even for such a inappropriate transgression. The waitress was not physically assaulted herself, so her response was totally wrong. She should have called over the manager to cool things down before they got out of hand. Mistake on the server's part. Verbal abuse can be intimidating, and working in customer service myself there is a certain amount one should not be subjected to. However, the server was not in danger and in actuality, in year's past would have been fired for such an action. It appears to me something has gone wrong in recent generations where children are being raised with the wrong values. But that's another story. Today I also think social media could be at fault and also pc gone overboard. But that's just my opinion from what observe in today's society. As a customer if the wait time was too long I would inform the server I'm leaving and if need be I'd call the manager over to tell them why.

Yes they both went over the boundaries and l agree it should not have gone to court. Unless the drink entered the customers eyes and caused a lot of discomfort. Or damaged her favorite top.Also the server was in an advanced state of pregnancy , no one can guess how she was feeling at that moment. Maybe she should not have been working at that stage of pregnancy.

I always ask servers how long I'll have to wait for this or that because I don't like waiting, especially when I'm hungry. I'm curious how long she waited. If I were the customer, I'd simply cancel the order and leave.

That customer was either very hungry or in a bad mood. She had a ticket so l guess she had already paid for the meal. I don"t know exactly how long the wait was.

Same here. The server's action was a reaction to her action. Who knows maybe she was the second or third complainant for the day making it the last straw...

Delayed service is common everywhere and I do not think I would react the way that lady did. Anyway retaliation was not called for and nor was it required that this matter should have gone to court. . At best the Management could have settled the matter.

I think so too. The customer probably realized that she had behaved badly in the first place - that's why she did not show up at the court.

Once we went to a restaurant. We were seated fairly quickly and they took our drink order. Then we sat and sat. No drinks ever came. No one came to take our dinner order. After half an hour, we left. We texted the management of the restaurant with the particulars and they sent a $50 gift certificate. It turned out that the waitperson for our table did not show up to work that day and they knew it. They took us to that table, not caring about us.

@Kandae11 There was a big party going on in a private room. That does not excuse them from seating us at a table with no waiter. I'm glad the management made it right. We did go back and got good service.

Was the restaurant very busy that day.? If they knew the wait person wasn't at work at least they should have said something. At least you got some redress.

At times things get out of hand. One should not verbally abuse another without letup. But then what the server did was rather unheard of. In such cases, I avoid such places after letting them know why I do so.

Both weren't able to contain their anger. They both have their own fault. I wouldn't engage in such unnecessary display of anger towards a server. Its shameful to act that way.

I don’t think the matter should have gone to court. Neither were right, but it wouldn’t have happened in the first place if the customer hadn’t behaved so poorly in the first place. The customer probably knew it wouldn’t go anywhere so she didn’t show up, and just let the stress of potential repercussions serve as punishment to the server.

Well if it were me and I was the server, I would have simply stopped serving her, but given the server's state of pregnancy, no doubt she as at her end of patience. If I get bad customer service, I complain to management if that is necessary, otherwise just leave. I have been on both sides of the fence here and just am not sure about the court issue. I guess it could be assault too. Yeah bad day.

The judge advised her that in future she should call a supervisor when matters get out of hand.

What l have noticed in many countries the law seems to be more serious when the crime involves money - - like stealing from the government, embezzlements etc.

There are many restaurants around. If l am unhappy with the service l am getting at one, l would find another. I would do the same as you or read a book if the waiting got too long and l didn't want to move.
