signing a legal contract

Can anyone please help answer a question for me, My hubby and i signed a contract with a company that we sub-contract for. We have since parted ways with the company and now they are trying to sue us due to a truck(ours)/(rented)trailer roll-over (they hired the trailer and are now being sued by the owner of the trailer). They didnt sign the contract, so is the contract legal? I thought that for a contract to be legal it had to be signed by both parties not just one.

It depends on which country you are in, i think? Some countries accept a contract to be binding on a pure verbal agreement too. I would think if you were subcontracting for them, were not insured and had been responsible for the accident, you should be morally obligated to pay. Before you think I am jumping or criticizing, I just gave my humble opinion and as you did not elaborate, I might have jumped to the wrong conclusion of what actually happened.

No worries, we are in Perth , Australia, the roll-over was an accident caused by a load shift in the trailer (limestone stuck to one side of the trailer while being tipped causing it to lean to one side and then fall over), when we signed to contract we were asked for ins, we had public liability and vehicle ins, there was no other ins asked for. We asked "do we need any other ins" and were told NO!
