This is weird but kind of funny...what made him think he could get away with it?

Hershey sues man who made pot candy Sun May 20, 9:54 PM ET SAN JOSE, Calif. - It was a big enough bummer for Kenneth Affolter when he was sentenced to more than five years in prison for making pot-laced treats and soft drinks. Now he faces the wrath of a candy giant. The Hershey Co. has sued Affolter, 40, for giving his marijuana goodies names like Stoney Rancher, Rasta Reese's and Keef Kat. Each came in packaging similar to Hershey's Jolly Rancher, Reese's Peanut Butter Cups and Kit Kat candies, according to the Drug Enforcement Administration. Hershey's suit, filed earlier this month in U.S. District Court in San Jose, accuses Affolter of trademark infringement, trademark dilution and unfair competition. The company is seeking $100,000 in damages. Papers were served on Affolter on Tuesday while he was in a county jail awaiting transfer to state prison. Affolter's lawyer, David M. Michael, said he was negotiating with Hershey.

Oh that is too funny- the things people do- Like Hershey needs to money- but they probably had to sue being that these were close to the packaging of their product. Too funny- I hope the guy does his time and has to pay a fine too- Can you imagine if little kids got a hold of this candy – thinking it was Hersheys.

they definately do not need the money it's the principal of the thing (this will deters from trying something like this)-using their trademark (a household name like that) could have been horrible for them and you are right if a kid got hold of it who knows what would have happened- they may not have known the difference. On the other hand- a few years ago I myself probably would have tried it!! LOL

Was he actually retailing them with wrappers similar to Hersey's candies?

Well, I do not see how they can sue him. People make cookies and other treats and put them on the market to sell. They even indicate that Hershey goods are used to make it---Like "made with Hershey's chocolate!" They don't seem to be upset by that.

That is not why they are suing...its because of the names he used to sell them under(Keef-Kat- instead if Kit Kat..etc)...that is trademark infringement
