Up-date On That Red-Tape I've Been Going Through

Three weeks ago, I started a discussion about all that red-tape I was going through about that IRS refund check that was part of my deceased mother's so-called estate, but since I'm her personal representative. With the other refund checks that were due her, I had no problem in getting the checks made solely and only in my name. At first, IRS and my state tax did mail the refund checks out in my mother's name...uh, don't think she could cash them being that she's deceased....LOL...So I had to mail them back with either a 1310 form or survivor's affidavit, then the checks were reissued and made only in my name. But then I had all this problem with this one check...maybe as it is a bit larger in the refund amount than the others were. They kept issuing the check with my name on the first line, then the second line had "Estate of...and my mother's" name. When I tried to deposit it in my bank account I was told I couldn't do that as my account in only in my name. So here I have this check, collecting dust, not doing me any good, as I can't cash/deposit the darn thing. Well I haven't been idle...I did call up that representative at my Congressman's office who had been so helpful and wonderful with me in getting my SSI benefits back when they had been cut off in May...it was only due to her help that I got my benefits back so quickly. Well, I kind of figured she couldn't help me directly as she only does disability issues, but she gave me the phone number of a Tax Advocate to call..Did, but all I succeeded in doing was leaving a voicemail, but her voicemail indicated another phone number to call for another tax advocate. Same thing, just leaving voicemails...yeesh, doesn't anyone answer phones in person anymore? But..just today, she finally got back to me, and even she was puzzled that my bank wouldn't accept the check...She said all banks should go by the first name on the check..in other words mine and I shouldn't have a problem in depositing it. In the meantime, she is going to look into it and is my official Tax Advocate Caseworker who will help me. She did suggest, giving it another shot and go to my bank, she said if need be my bank can call her, and she provided me with her Tax Advocate Badge Number...hey, it'll be more official. She also said, she had recently mailed a letter to me explaining things also, so I'm hoping I get that letter in the mail and I can show the yo-yos at the bank proof that I have someone working my case in my behalf. So either way...wish me luck that I can get that check deposited!!

Good grief! I'm very glad you found someone that will finally DO something, but wow, what an ordeal! I'm not surprised you have had such a hard time with these places. Government agencies are just something I'd rather not have to deal with. But darn it, I always do.

Hahahahaha that was a one of lol I am fighting to get help towards my Electric as I have to keep warm and the electric is to high so 2 days ago I phoned and someone was suppose to phone back and hasn't so I will be on the phone again tomorrow

Red tape always means a big headache is attached. I tried to cash a check from an insurance company. My bank wouldn't let me cash it. I could deposit it though. Of course had to wait for it to clear before I could use the funds. Best of luck in getting this resolved.

Oh that is such wonderful news Melanie. Funny how things work out isn't it? Just when you were having such a horrible time with your SSI did you have the fortunate luck to meet someone that could help you out with this matter, life can be challenging at times but it is only challenging to help us learn and get better at the next time around. oh my I got dizzy reading the topic already. yep I had my share of red tape but not exactly like yours. but it's strange how the bank said you can't deposit the checks, it is under your name, doesn't matter what the second line says. sure I wish you luck my friend

i guess red-tapes, and bereaucracy procedures - in any country - are just so troublesome. and yes, bank procedures... they can be very confusing too, can't they? but i would say that you are sooo lucky that you have people that would respond, support and help you through the whole 'process'. so.. good luck... i am sure you will get the money deposited... some how... some way.

Good luck on getting the check cashed. And for the loss of your mother I bid you condolences. Dealing with the bueracracy that we put in power is so very difficult these days because there are too many people working at government jobs who are not competent to work anywhere else and yet we as the American people pay the government and the IRS and the cops to inconvenience us and cost us all money! It is an insane concept when you look at it that way.

That's kinda bizzare... I mean, I deal with this kind of stuff probably 4 times a year. We do Estate tax returns where there's actually a bank account for the estate and that makes it much easier. But, we also do plenty of them where there is no estate, and we don't have problems. The biggest thing is, I do deal with this all the time so I know what to do to get it done as painlessly as possible. The normal person doesn't deal with this all the time and they aren't sure what needs to be done. I'm glad it looks like you were able to do the leg-work and get it taken care of.

I wish you luck. We had the same problem with money we put in UICS from my father-in=law's estate, that we had to take out. My oldest sister-in=law and my husband were executors of the estate, and we had to sign the checks in both our names, but then my sister-in=law got a form of ALS and could no longer sign checks, so it took a while to get her name off the check. Do not worry, it will take time, but you will be able to cash the checks.

Boy, talk about red tape!! Just a suggestion but when you go to the bank I'd make sure your talking to the bank manager and not just a teller...alot of times things are handled easier that way. AT PEACE WITHIN ~~STAND STRONG IN YOUR BELIEFS~~

Well everything has been sorted out. I got a tax advocate to help me out and I was finally able to deposit the check..thank goodness!

What is it with you and red tape? It seems that everytime that you turn around you are falling into the arms of the beast. I will light a candle for you, but I think that we need to figure out what messenger god you upset. LOL.

Oh brother...or sister...I do not envy the mountains of red tape you've been wading through. Shows what you can do with persistence...and I sincerely hope you will get the check deposited, approved...and cashed. Sounds like you are due for a break my friend. I like what one of your friends said on your venting discussion...find someone to give you a hug..take a day to nurture and re-charge yourself. You do not want to burn out! This is just proof positive that you are anything but lazy..or lacking in motivation and perseverance. Good luck with everything...keep on keeping on...you will eventually get where you want to be...I am sure of it!

Thank you perspectives..actually today/night was a good one for me, as I kept myself away from here for awhile to cool off, and spent it working on my crafts...how can I ever be annoyed when I'm working on one of my teddy bears .... :) oh,yup I'm due for a break...a nice one!

What the heck- I hope that this gets straightened out soon- I hope your bank will be able to help you- I’d go to the teller and try again- and then ask for someone higher up there- even the bank manager- Maybe- just maybe they can help you! Man that stinks- I’d be mad too- At least someone called you back and will help you out- I’d give them her # and badge # also if they say no at the bank- maybe they can call her and get her-

I hope by the time I am writing this you got your money. I hope the yoyo's at the bank got their shi! together so you could get the money owed to you. Now I hope you let the social security know you have this so they will not pentilize you an income. LOL Good luck

What what a pain in the butt your bank is being! I hope that letter will help you out so you can show them, if all else fails try a bank manager. The check is legally yours and in your name so if they can get over themselves and read correctly then you should be fine. It's also great to see state officials helping people out, how rare! I do wish you luck but it does make me wonder who is working behind those counters at your bank? Geeze. I've never heard of such a thing because a name is a name and it doesn't matter if the other is on the account or not at least one of them is. Morons is what I say they are. Sorry they're dragging this out for you as if you don't have enough to worry about. Good luck!
