Do you think this is medical malpractice?

Okay I am going to make this quick and to the point. Back in May I hurt my back and my legs and feet kept falling asleep. So I made an appointment with a local pain doctor that also works on backs. He ordered an MRI and CT Scan. He wants to do surgery on my back, because of a protrusion on my spine and degerative disk disease. I won't let any Doctor cut me open at the local hositpal (they hack people) and wanted a second opinion. The place I am going to is in Indianapolis and they asked me to bring a copy of my medical record with me. So I went and got a copy of it today. I started looking through it, I was courious to what it said. I get to the form where I had my MRI and the results from the MRI place and it says in two different places on the form I have Gallstones. WTF, I had these test done in June and no one from his office nor my doctor has said anything about gallstones. I feel that it is medical malpractice. Don't all doctors take an oath to do no harm. How is letting me live with gallstones and not telling me about it not doing any harm? I have been in pain for months, and from the research I have been doing since I read that I have gallstones, explains 90% of my problems. What do you think is this malpractice? I think it is for reasons I stated above.

It really depends on if he read the results of the testings and if he did the surgery that was stated. Malpractise is when a doctor preforms a prosedure that was not nessecary and / or causes problems after the prosidure. It is your responsablity to ask for the results from all tests done in the doctors office and then let them tell you the results and treatments. I would certainly call the doctor and ask why I was not told of the gallstones as they can cause other problems along with the ones you already have. I do agree that for 4 months you should have known by now about the gallstones and that treatment should have been done by im or the second opinion. hugs

I went in for the test results and all he told me is that I had a protrusion of the spine and degeratitive disk disease. Never mentioned gallstones at all Bambi, it makes me so angry to even think about it, because I have been having lots of problems here lately, major main in my back of course, but pain under my ribs on right side and chest pains here and there. All signs that my gallbladder is in trouble. Though I didn't know any of this until today. I have an appointment with the surgeon this Friday, my other doctor is mad, that I wasn't informed of this sooner, heck, he said it would have saved me from having to have the invasive test I had to have done. Which made me sick. The surgeon is seeing me on an emergency basis, people normally have to wait 2 months to get in, so it must be bad. Oh well at least I know now.

I that case get a hold of an attorney becuase the doctor should have at least warned you of the gallstones. The attorney can tell you if you have a case or not. Good luck and get better really soon hugs

I am having it removed the 23rd of this month, can't wait. Tired of being in all this pain.

I personally would say so, after all it is your body and you have the right to know and freedom of choice.

My Hubby has degenrative disk disease and they wanted to do surgery on him. He refused and later when he told his VA Dr. about it he told him that more than likely the surgery wouldn't have fixed it anyways. A friend of mine in Texas also has it and she did get the surgery with a 60% chance of walking afterwards. She's wheelchair bound now and has 4-5 more surgeries to correct what they messed up in the first one. She wishes every day that she'd never had the first one to begin with. Me personally, I'd never let anyone cut on my back. There's just too great of a risk there for error. One slip and your paralyzed for life. **AT PEACE WITHIN** ~~STAND STRONG IN YOUR BELIEFS~~
