Oh no they can't do that! They will be committing bigamy if they do that. Anyone who knows taht the woman is already married can file against them. The best thing that they can do is file annulment. Adultery is far different from bigamy... wherein adultery can be file only by the innocent spouse (her legal husband) but in bigamy... it can be file by the family of the spouse... its a big problem.

Actually I am separated from my husband too... but he cannot marry his another woman because that would be a case... we decided to have an annulment. As of now, they are living in. As long as they do not get married I think there would be no problem... but if they do... they can never be sure.

I agree with everyone that said they can't do that. She needs to be legally divorced from her husband before anything else. It doesn't matter if they've been separated for a day, a year or 20 years. She needs a divorce first.

Do you have divorce in your country? In my country, divorce, legal separation and physical separation are all different things, but only a legally finalized divorce can allow you to marry another person.

They need to make sure the woman is divorce first. Yes bigamy is definitely what they would be doing and they will get in big trouble if they go through with the wedding. Surely someone would have told them that they need a divorce.
