Grrrrr! My disability claim was denied!

Actually, it isn't a real big surprise that they denied it. I've been told by many people that trying to get Social Security Disability to approve a claim is harder than pulling your own teeth without numbing them first. ICK! Anyway, I just got my "rejection letter" today. It didn't make me very happy. But my appointment with the dietitian for my weight loss surgery is next Friday, and my surgery might be bumped up sooner. And from what my doctor tells me, my having the surgery will automatically qualify me for benefits. So I'm going to hold off until next week and see what happens, THEN maybe I will still go ahead and file the appeal. Any advice for filing that appeal will most definitely be gratefully accepted. (Pretty please?). Hugs to all of you.

Appeal the decision. You have a limited amount of time. Do not start the disability procedure over again.

It is hard to get approved. I have Multiple Sclerosis and it took me 3 times to get approved. The thing to remember is to document, document, and document. Everytime you see a doctor for the problem you are trying to get approved for or a complication of that problem---have it documented and sent in. I am so happy that you are starting a life long journey with the weight loss surgery. I had mine done in August 2003. It has made a world of difference in my life.

Don't feel bad, mine has been denied 3 times now. I have been fighting them for over 3 years. I have Social Phobia and cannot be in public too long before the panic attacks start coming. I also have Bi-Polar disorder, Avoidant Personality Disorder, Panic disorder and Chronic depression and each time it gets denied. Is this your first claim? Because almost all first claims get denied and then you have to appeal it. In my case I have appealed it twice and am getting ready to get myself a lawyer because I have been told that it is best to get a lawyer after you have been denied a couple of times. That would be my best advice to you, first appeal it and if you get denied again then get a lawyer. Yes they take about one third of your money but it might be the only way you can get approved. I have heard that it is difficult to get disability - my mother has been denied three times now. She is currently waiting for her appeal hearing.

That surely wasn't exciting news for the holiday....bummer city...Keep filing until they accept it. Make sure they have your doctor's records..Don't give up PPP....

That's what I intend to do if my surgery isn't moved up sooner. I'll be letting my doctor know about the denial probably tomorrow, so we'll see what happens. Hugs!

I have been on Social Security Disability twice, and had no trouble getting on. I have juvenial rhuematoid arthritis and was on my back. I had to see 2 Dr.s my personal rhumataligest and one that ss chose. I did't have any trouble getting it. I lost it after 2 years because I was able to get around and do much more. I got bad again 3 years ago and applied again and got it with no problem. Then I got old enough to get the regular ss and that is where Iam now.

Good for you hon. I'm hoping my regular doctor will get it all straightened out for me. He deals with disability and workman's comp, so maybe he can get it to go through this next time. I'm just waiting for the appointment next week to see what happens before I take anymore steps. Thanks so much hon. Good to hear from you sweetie.

Sweet I fought a year and half for mine In the end I asked them how they can deny me when they have not even sent their own Doctor out to me which is suppose to be one of their Proceedures Do not give up Sweetie keep fighting them and do ask them about the Home visit from their Doctor

Well you could tie them to the chair and force them to watch that movie by Michael Moore. I head that disability claims are denied right and left, so I would suggest that you get a lawyer on medical insurance and social security claims. I heard that things are bad there down in the States, I guess you have to have doctors's proof that you tried everything possible for weight loss surgery, not just that of dietitians. I gather they think it is electric surgery and that might be the problem.

It used to be considered an elective surgery, but now more and more insurance companies are changing their policies on it. But with my insurance, I have to go to a hospital that is on it's list of centers of excellence. That's what has taken so long to get it rolling. That, and trying every method possible to lose weight first. But it's going to happen soon. If nothing else, it's scheduled for April 3 for now. But if I pass the little test that the dietitian gives to make sure we know what is required of us after surgery, the procedure will be moved to a closer date. Oh....and I love the idea of tying the disability reps to chairs and forcing them to watch that movie. Maybe it would open their eyes a bit. Thanks hon.

Was it your first try? Because almost everyone gets denied the first time. The second time is difficult too. You might end up getting a lawyer, but the third time I bet you'll be accepted no matter what. The key is to be on top of it all. Keep the ball rolling, don't let them forget about you. Some cases get buried and forgotten about and by the time it comes up, the poor person is already healed. But of course dirt poor for receiving no help.

Yes, it was my first try, and I sort of expected this outcome. But it was still disappointing just the same. I'm just waiting for my appointment next week for my surgery. Maybe they will move it up to a date that's close enough that I won't have to go through the appeal process. Keep your fingers crossed please. LOL! Thanks hon.

I was the same way. I thought surely, even though it is my first try they will see how very much I need it. But nope. A woman who worked for them who used to go to my church told me they almost automatically send a denial to everyone, just to see who pursues getting it. Sort of like, weeding out the people who are serious and the people who thought they'd just give it a try. Pathetic reasoning to me.

well i am not american, so i cannot help you there, but yes, i know how hard it is to file, because a friend of ours in on and there are a ton of limitations that you can and cannot do after you are on it! good luck!!!

They will probably want to send you to their own doctor. Do so, jump at the chance - you might want to get your doctor to send over records to their doctor as well. My friend was denied once and when they sent her to their own doctor (we liked him) he told her that if she weighed 100 lbs instead of 350 lbs, she'd still be disabled with her knees. They only denied her once! I know another lady who's son has spinal bifida who was denied 3 times! No that she's doing anything to lose that wieght like you are. But she can't get knee replacement while she weighs so much, so she continues to be disabled.

They actually already sent me to an evaluation with one of their chiropractors, and the verdict was still "no". I have an appointment with my regular doctor next week before the one with the dietitian, and I am going to let him know what is going on too. One way or another this will get straightened out. What ever you do, don't give up because that's what they want you to do. They're trying to discourage you so you won't appeal it, so APPEAL IT!! lol I made the mistake years ago of not appealing my claim and now I don't have enough points to get it anymore. I was young, dumb, scared and alone so I didn't know any better. Big mistake and now I'm paying the price. Such is life.

Believe me, I'm not giving up. They haven't heard the last of me for sure. I've got an appointment with my family doctor on Thursday, and then the appointment with the dietitian on Friday. Somehow, between the two, this is going to get resolved and go my way. I gots my fightin' gear on now! LOL! Thanks hon.

You're always turned down the first time, and often the second... keep filing online... when you are contacted, make an appointment. Once you get to a person, your chances are MUCH better! I may finally file next year, if I'm still as bad as I've been, but my lovely new doctor thinks we can turn things around for me... I'll see her soon, and we'll start with hormones and a visit to the hand specialist. My weight is going down a little at a time, and that helps, too. We're all gonna be brand-new... the BRATS are on a mission to reclaim LIFE!!! BIG hugs!

They say misery loves company, so if it helps I'm in the same boat, Hon. I'm awaiting my first appeal but I've been told it's pretty common to get turned down the second time too. I've contacted an attorney and I don't pay them unless I win and they can only get 25% of my settlement (which now stands at about 30 months) with a maximum of $5600. Didn't you just love the ridiculous questions they ask you? Are you able to dress yourself...I guess unless you can't dress yourself you can work fulltime! Make sure you do as another poster here said and document all your doctor's appointments and any kind of medical treatments or tests. I've been waiting for a former co-worker who had a hard time getting his own claim approved to get back to me, he said he may have some advice to help me. When I hear from him I'll let you know if there's anything that might be helpful for you. Annie

Okay, I read some posts and now know why you need Disability. I've been around so many lazy people who find excuses for living off the government that I sometimes forget that there are people who really need help. Hopefully, your surgery will help your situation healthwise and financially.

I think you have a good idea to wait until the surgery because if that will automatically qualify you for the disability benefits, it will be much less stressful than fighting Social Services. Were you applying for long term benefits or short term? Long term benefits are always a challenge to get because it means more money from the budget. I haven't been reading your posts lately because of time and access to the internet so I don't know all the details about this. Why do you need to be on Disability? You may have told me this before but I just don't remember right now.

I'm hoping to get it for at least 2-3 years until I can lose the weight and maybe get the pain in my hip joints and lower back to go away or at least lessen. I have a very hard time walking, sitting, or standing for any length of time, and that is making it too difficult for me to do much of anything. I've got the necessary papers printed out in case my surgery remains on the same date just in case. Thanks so much hon.

I was denied the first couple of times too and than I got a lawyer for low income people, who specialized in Social Security. Are there any attorneys in your community who can help you? I certainly hope so. There may be a community legal service for you. Good luck in your appeal.

I can say that working with insurance companies that the more proof you have like a letter from the physcian treating you and the surgeon might help make it go smoother along with a copy of your medical chart and a second opinion. Unfortunately I have been told by many people that have gotten SSD that they were rejected twice before they actually received it. I hope that all goes well with your surgery and that your SSD gets approved. Have a nice day.
