American Flag with Stars - The First American Flag to have any resemblance to the present Stars and Stripes. 
The present Stars and Stripes was the Grand Union Flag.

First flag of the colonist to have any resemblance to to the present Stars and Stripes was the Grand union Flag, sometimes referred to as the Congress Colors, the First Navy Ensighn, and the Cambridge Flag. Its desighn consisted of thirteen (13) stripes, alternately red and white, representing the THirteen Colonies, with a blue field in the upper left hand corner bering the red cross of st. george of england with the white cross of St. Andrew of Scotland.

The flag that you refer to here is the flag of the military of The United States of America and signifies Admiralty/Military Law (or jurisdiction). There IS a civil flag of The United States of America, that signifies Civil, non-military, jurisdiction. It was commonly flown over Custom Houses to signify that they were under Civil jurisdiction, not Military Jurisdiction. The Flag with the horizontal stripes was flown by the Military in time of War. Most ppl today don't even know that there is a Civil flag, partly due to the usurption of Civil rights by the Federal Government by the Buck Act of 1940, which extended Federal Rights over the States, via the Internal Revenue Service and the ability to collect taxes from States, and private citizens and businesses.
