Another Rant: Going Through Red Tape Bull Do-do Again

Well here's another rant of mine...It seems I'm going through the same aggravation now as I did last year. I had actually started a discussion about the red tape I was going through when last year I had gotten a tax-earned income credit refund from the IRS for tax year 2004. Some of you may remember the hassle I had last year, when around September when I received a tax earned income credit refund that was due my mother, but since she's deceased and I'm her personal representative am entitled to. I had been trying to get that check issued in my name only then, but the rules and regulations of the IRS state that while the first line of the payee check is clearly with my name on it, it HAS to have "Estate Of ...." my mother's name. So when I tried to deposit the check in my bank they gave me a song and dance that no, they couldn't deposit the check into my account and would have to go through this whole hassle of getting Letters of Administration from Surrogate's court, then come back to the bank and open up a separate account with the "Estate of" bullcrap. That's when I had gotten in touch with a Tax Advocate, and she said NO...I didn't have to go through all that, that as long as the first name on the first line of the check was clearly MY name the bank had to honor it....So I went bank to the bank then and after much mumbo jumbo and the bank representative calling the legal department the check was OK'd and was able to deposit the check. Well now I finally got a new refund check that is due to me too, and another tax earned income credit refund for tax year 2003 and it was issued out the same way as previously...my name first, my mother's name second... I went to the bank today, armed with the letter from last year by the Tax Advocate, a print up of when I had deposited the other refund check and a photo-copy of the last check from last year....BUT NOOooooooo! Having the same friggin problem now....I did just call the Tax Advocate's number again, but could only leave a message as she wasn't there..I mean what is the deal here? any advice here???? The jerk that I talked to at the bank said to come back tomorrow and I could speak to some supervisor...but why this friggin' hassle again??...I CLEARLY was able to deposit that refund check into my account without too much of a hassle, so why the hassle now...you have any idea HOW MUCH I need that money?? Wasn't that letter from a Tax Advocate enough? In it, it clearly states I don't have to get Letters of Administration or open a separate account. The jerk I was talking to said that the letter from the Advocate meant nothing....that it wasn't something from the IRS itself...Tax Advocates DO work with and under with the IRS and have as much authority legally wise as the IRS. Tell me your own aggravations with your bank....would love to hear

Sheesh pye, sounds like your banking at the wrong bank. With all the hassles AGAIN after last year. Hate to say it, but I haven't run into any hassles at either of my banks and I've been with the credit union for almost 20yrs. Only been with the other bank a few years but still, no hassles as of yet. Hope everything works out soon for ya, pye.

Pye since we are neighbors I can tell you stay away from that WaMu where we live or else I will be visiting you in Rikers because you will go off on someone there. The worst bank branch I ever dealt with in my life.

Wow! You would think after being there so many years, they wouldn't give you any hassles. But then, like you said, the ones that have been there forever knew you well and knew what customer service was all about.

This is HSBC bank..not some turkey jerky dinky bank firm...I've had my account there for something like twenty years there too...it's unfortunate that most of the "older" more reliable help that used to be there either retired now or transferred...There is another bank near me...WaMu..(Washington Mutual)--I've heard worse stories about them

The simplest way to deal with this problem... would be to ask the IRS to issue your check with the name that your bank wants on it.

They won't do that...I had this exact same problem last year...they HAVE to issue the check with my mother's name on it for tracking purposes and that the money was originally designated to her...believe me I went through this shat before..besides even if I did send the check back now and even IF they did reissue the other way with just my name on it,it will take a month or more to get the re-issued check...Aussie you have no idea how much I need this money NOW!!

How about changing the name of your bank account... so that it includes your mother's name? Or make it a join account with both your name and her name. However... make sure she did not own money to anyone before you do so.

That's a no do either Aussie...I went through the hassle where I actually did go to Surrogate's court (quite a distance from me) to get a Small Estate Affidavit..they told me to get it, I needed my mother's original will, not the copy I had, and a Third Party Affidavit for Sole Distributee Child signed, notarized and filed out...would need the same for Letters of Administration which the bank claims I need to have to open up another account with my mother's name--problem..of course....my mother made out her will in 1985...the law firm no longer exist...where the hell the original will now is anyone's guess....as for the Affidavit...I need it filled out by someone who knew my mother at least twenty years and can verify she never remarried, and I'm the one and only sole survivor...So no chance of getting either the Small Estates Affidavit or Letters of Administration so you see the fun I'm having here? NOT

gosh that certainly would rile me up, I have had my share of crap with banks too. It is incredible they don't know what they are doing half the time. Down here we watch for the tellers we know the good ones from the bad and even forfeit our place in line to get the teller we want because they do not all work the same and that is something I cannot understand.

sure wish I could help ya on that . I just dont know about this kind of check refund from the IRS only thing I got from them is $255 when he passed away and that was it no refund fund check for earned income. But seems to me you armed with all that they sould have let ya put it in grrrrrrrrrrrrrrrrr

If the check is made out the same way as the previous one which you deposited then they have to do it again especially if you have the proof that it was done last year. There is no excuse for this kind of harrassment and that is clearly what it is.....I would file charges if they keep it up.

Well I hope I can get it straightened out tomorrow when I go back and the supervisor is supposed to be there. I unfortunately had to deal with the same beech I did once before..grrr...can't stand that woman!! Wanted to dump the remains of her coffee she had on her desk on her head

Why are these stupid @$$es giving you this freaken run around? Are they just not wanting to do their job but get paid for doing nothing? I'd be one peed off MF I know that!! well send some prayers over my way that when I go back tomorrow and speak to the supervisor can get this straightened out..you have no idea how much I could use this money--yes do think these people at the bank are from mars
