Frozen Assets...

Recently I was reading an article about a couple getting divorced. The property had been settled, the child custody and support had been settled, the alimony had been settled…there was only one thing to settle………the husband’s sperm. It seems that the couple had a company freeze some of the husband’s sperm when they were having trouble conceiving. All of it wasn’t used and now there is a battle going on over it. The husband wants it destroyed so it can’t be used and the wife wants it kept so she can later conceive more children (with no penalties or obligations to the father).
I think it should be left up to the husband since it is his to begin with. I think if I was divorcing someone the last thing I’d want is more kids by him. I’d raise the ones we’d had of course but to insist on more wouldn’t be for me.
When Hubby divorced his ex she actually asked her lawyer to have the Judge order Hubby to come over and “service” her each week…her ultimate goal was to have more children by him thereby getting more support. Of course, her lawyer wouldn't ask and the subject was dropped.
Would you ever want any or anymore children by your ex if you were to divorce? Would you ever ask to have an ex come and “service” you each week? What do you think should happen in the frozen sperm case?

I've heard of this happening before and I think they sperm should be disposed of. I mean, the marriage is disolved, why create more children from it? Children are supposed to be made from love, divorced people don't love each other any more...

There is no way I would want to have more kids by my ex. Nor would I ask for that person to come over to "service" me once a week. That's just crazy. As for the case of the frozen sperm, I agree that it should be the husband's decision as it is his sperm.

Wow,wow, and wow.
Toatally must have been him doing the Divorcing then for her to have those stipulations of getting "serviced weekly by him. Although as yo said it could have been just to have more kids for more money she could get. I wouldn't want to be serviced by a man who divorced me especially because he didn't love me anymore. Maybe so-so with the sperm I can understand how she might want all her children to have the same father and be full blooded siblings, but it sounds fishy, as though it would be something else she might try to get revenge of some type so as a judge I would rule no deal on the sperm going to her.

This is the silliest thing i have heard yet.The sperm now belongs to the husband ,it is his to do with whatever he chooses.She is divorcing him,so why does she want his future children? Makes no sense to me...If i were the husband i would say "if she don't want me she don't want my sperm"...I had 5 children with my ex,i was glad that he was the father ,and the only father of my children but if i divorced him , i would think he should be free from future obligations other than the already born children that they have...

That lady was nuts wanting his sperm or to have him 'service' her. Man, if I was to get a divorce, I wouldn't want any part of my ex-hubby. His sperm, he gets it. I sure wouldn't want it. Besides, I don't want anymore children by anyone. One is enough for me.

The husband is the one to say what becomes of this sperm... the woman has no say in it at all.
I would think that she would want any subsequent children to be by her next love interest, and not by the husband she is divorcing.
As to the no penalties and obligations to the father bit, that is a fairy tale, because if she were to have another child because of the frozen sperm, the husband would wind up paying the child support for it... that is how screwed up the laws are.
It is too bad that the hubby's ex's lawyer didn't run THAT little request by the judge... if she had it may have made a dramatic difference as to her getting custody of the kid due to her obvious mental instability.

Things are getting pretty strange and bordering the ridiculous at times - which I understand as normal for the human race. However what baffles me is the fact that those things are even considered in legal grounds. Incredible LOL
As for the sperm.. it's is, of course, unless he sold it to a company which does not see the case here and in which case it would belong to the company and not him.
I can certainly understand that this woman might want to have more children fathered by her ex. Maybe she is looking at it from the genetic point of view and the man has really good genetics or something. Regardless of what she mnight want, what she might be allowed to get is something completely different of course. And his decision at this point, nobody elses.
Woudl I want to be "serviced" by my ex for that purpose and after divorce? I can't be completely sure since I was never in that position but first thought is...: NO :) Or else why would I want to divorce him in the first place? Of course it could have happened that it wasn't my choice but then again, if it wasn't why would I want it in that case?
Oh well.. it's a crazy world we live in, and getting crazier by the minute:)

"Servicing" that's just sick and I'm glad her lawyer didn't agree to putting it in. I think that if she used his sperm, it should only be with the signed form that she couldn't sue him for support for any children she conceives after the divorce. But, I would side with the husband and have the sperm disposed of. Unless he can't have more sperm harvested, (consider Lance Armstrong) because he might remarry and his new wife might want to have children.

they should destroy it,unless there's some reason the man can't make more.they shouldn't even think of giving it to her,they are divorcing.
she can go into any donor bank and get a new donor.

This kind of madness sounds like it can only be in the UK,as it seems that the judges are more interested in looking at the women than actually using commonsense in their rulings,dont care how outrageous the demands from a woman are, they somehow seem to always find in her favour,men seem to always get a bad deal in cases against women.
The sperm belongs to the man, not the woman,she as far as i know dont produce sperm,but this article shows how selfish some women can actually be.

twoey I think that woman is a bit nuts. most women would
not want more kids from a man they dislike so much they
are divorcing him. The man's sperm belongs to him and he
should have the final say as to its disposition. She sured
has a lot of nerve wanting him to service her just so
she can have more kids and more alimony. that will not hold
up in a court anyway so she is out of luck there.I would
not act like that woman were I in her place. no more
kids from my ex and no more contact atall.lol

I think this is ludicrous! It's HIS sperm!! And he should not be forced to have a baby if he doesn't want to. Regardless of penalties or obligations (unless he of course impregnates a woman himself LOL). Because if he's any kind of man and he knows he has a child he will fell obligated to be a father to that child. Crazy...
If that woman truly wants more kids then she should go to a sperm bank.
I think if the man wants them destroyed than they should be.

i think that if a couple divorces that should put an end to the relationship. Period. To want something like what you described is despicable. I have often wondered about any saved sperm, eggs,etc and the legality of saving them. I can not imagine a couple who are divorced wanting to procreate. I know I would not want to do that. I can agree with any man who does not want to service his ex so she can have another child. I don't think the court would like it either.

I think this case is very stupid because the guy should have the right to decide what to do with his sperm ,and this woman is completly out of her mind. This request should be dismissed and the divorce should be granted and finalized.

If I would want more kids with the person I was getting a divorce from then I would stay married to him and there is no way if divorcing would I want him to "service" me ever.
As for the sperm, I think it is up to the man to do with it as he pleases. I don't think that she would have any rights to it at all.
