Ok so I feel like I am living in hell. My landlord has a pizza shop right below me and anyway He has workers doing remodeling from 10pm-4am then again from 6am-11am. All night all I hear pounding and drilling and lots of banging. I have a baby and its been hard to get him to sleep through it and then I can't get to sleep. Is their anything that can be done? I talked to my landlord but he didn't care.

Let me start out by saying I am a Landlord. In every state, there are noise curfews. Your police should be able to tell you what they are. If this keeps up, I would document days and hours they work past the curfews yu are tld for your area. Since you have already talked with him about it, your next move would be to put in writing to him your complaints, and mail it so that he must sign forit to receive it. Keep a copy to show when you take him to court. Just make sure your rent is paid up, as well as your utilities. Don't give him any ammo to use against you. Have everything clean, and as it should be. If you don't want to do this, I suggest moving. If you take him to court, he may also evict with a 20 day no cause eviction, and these evictions give the tenant no leg to stand on. Me? I'd save up my money, and move!

Yep I am a landlord to. Those are all good suggestions. I also wonder if this is temp. It seems like You were saying some remodeling was being done. I would call police each time to. If noise hours come up and noise is going on call police and document it. My leases state something about quiet enjoyment. One of My houses has 2 flats and of course I don't want 1 flat noisier than the other or at the sleeping hours. Even if just 8pm since one has little kids. Neighbors will call but if inside like that and downstairs like you described it might not be bothering other neighbors. I believe police would tell them about the law. Further instructing them to do this work during hours that are normal for noise and not to loud. Oh yeah and if it was me I think I would find the info online for quiet enjoyment in your city/county and suggest that You will not be paying rent for a noisy rental property. If that doesn't straighten up night hours for You then I would get a pro bono attorney to help Me. Good Luck and let us know how it goes and remember God Blesses! Sandy

That's really bad I mean he should care because your his tenant and your paying. Did you tell him that you have a baby? I live with my mother in an apartment building and everyone here is always making noises and fighting really loud and all of this. And we've been living here for a long time so now when they do stuff like that I really don't even hear it because I'm used to it. But you should try again because you do have a baby.

Hello dear mollyrose. I am sorry for you to live in such a place which is noisy, but I have to say that you are not alone there because my parents also live in such a place. My parents' apartment is on the second floor while the first floor is a shop as restaurant and the owners of the shop get up very early making a lot of noise by opening the rolling iron door and making food. They do a lot of pounding and drilling and lots of banging as well driving my parents crazy as they cannot have a good rest, especially when they make the loud noise early in the morning at four or five o'clock when people are still sleeping. I could not suffer from it when I lived in my parents' apartment for one night. But my parents could do nothing as that is apartment we bought. We have to suffer from this. So sad to say this. As to your case, I think that you can try to find somewhere else to live if they ignore you for your complaints about this. I hope that they will listen to you . Good luck, dear mollyrose.
