Supreme Court Decision on Child Rape

The US Supreme Court decided on a 5-4 vote that 1st degree rape of a child (Under 12 years old) is not punishable by death. Doing so would be "Cruel and Unusual Punishment". Most of the states only allowed the Death Penelty after the 2nd conviction of 1st Degree Child Rape. To me this gives a person falsely accused a chance to change, if not then we need to make sure that the person never has the chance to do it a third time. My other concern is will a more liberal court decide that life with out parole be consided "Cruel and Unusual Punishment" because the person could argue that it is a death sentence if you have no hope of getting out of jail. Mean while the victim has a life sentence and is permentently damaged mentally.

"life with out parole be consided "Cruel and Unusual Punishment" Well how cruel was the murder of the person they are committed for killing! How cruel is it to families to loose a loved one for no reason! Geez - these liberals are pathetic! I'm a nice person but in cases like this, I'm sorry but maybe these judges should walk the walk of a victim and their family and "see how it goes" and then make their decision as to whether it is cruel or not. They act like if this crime was done to their child, they'd have the "fairness" to allow the criminal to be nicely taken care of. Give me a break!

Wow! You mean they prefer to protect the aggressor than the agrieved. I can't believe our justice system is really that bias towards children who are rape victims. Is that a sign of gender bias? I mean, how can it be ok to let a man off deathrow when he has ruined some poor girl's life? Is the value of a female life lesser compared to that of a man? C'mon, you can do better than that.
