I get Social Security Disability & School Loans Say They are Going to Take 15%

I've been sick for a long time, I just kept getting worse and worse and I had actually resigned myself to the fact that I was going to die and I was sort of ok with it. I felt too awful to really do much of anything about it anyway. So my mother, who is quite agressive and pushy, basically hauled me out of my bed and to apply for any and every help that I could get. Finally, after the second time, I was approved for Social Security Disability. Which is great! I mean, it is just enough to pay the rent and for the co-pay on my meds with absolutely NOTHING left over. I even have to have a bit of help buying my own food, hence my terrible food choices [sorry, that's a different story!].
Anyway, where I'm going with this is, I have defaulted school loans. Yes, I owe them and I didn't make payments because sickness, laying in bed equals no income. I didn't support myself for several years [thanks mom and dad] until finally I got SSI. So now they [school loan place] say that they are going to attach the SSI checks and take 15% which is $135 every month. My rent is $825 [I can't live alone cuz I still can't completely take care of myself yet so I had to move in with my daughter and her kids]. And then there is the co-pay for several medicines that I take. Once they attach the check, I dont' know what to do. We have looked for a cheaper place to live, but it does NOT exist in today's economy! Plus I have bad credit, guess why! so renting another place is an impossibility anyway.
I'm wondering, does anyone know anything about this? Is there any way to stop it from happening? Do I need a lawyer, would that even help? I'm really lost and feeling some major depression over this [just one of my many medical issues] and feeling hopeless about this problem on top of so many other problems.

Hi horsesrule, I have a senior citizen friend who is on Disability also and they tried to garnish her check, they even put a hold on her bank account and she was advised to go see an attorney and the lawyer told her disability checks/income is exempt from collection because is is NOT considered gainful employment. If I were you I would contact an attorney and get advice and help from him/her. I know your disability incomes is low and 15% is a lot of money to take from that. Check out attorneys that handle disability cases in your area, the consultation (1st) visit is usually free and ask if you can get some help. When you call for an appointment make sure you ask if the consultation visit is free. DO NOT sign anything unless your sure you want to use that attorney. You might want to see more than one to make sure you get the same advice (second opinion) and then pick who you like the best. I would have an attorney on this, if they try to put a hold on your bank account he/she can have it removed - you need the protection of an attorney. Good luck!

The link I sent shows question #35 regarding liens. This is something new that congress passed but don't let this discourage you. Even if they are allowed now to collect from student loans an attorney usually can get the amount reduced significantly. You really should seek legal advice, it's in your best interest and you will probably save yourself a lot of money.

Is there a Legal Aid office in your area? They're free or charge very, very little. That may be a good place to start.
I'm sorry you're feeling so bad and having such a tough time, but there are brighter times ahead.

There really isn't any way to stop it...you might talk to the student loan place and explain the situation and see if they can work out lower payments with you. You might also look at getting on HUD if you qualify. It sounds like you should. BTW, getting a lawyer probably wouldn't do much and would only result in another bill for you.

my dear i am so sorry that this is happening to you i am sorry that i am of no help to you as i have no knowledge of how the system works where you reside.don't give up ,keep knocking on doors and some-one will have the answer for you. some-one will see your post and will give you the advice you need.
