Settle an arguement for me...

Ok, my husband and I were talking about his brother getting busted for under age drinking. This led to the question of wether he would get a DUI too. I said no because according to him he only drank two beers. I said two beers wouldn't have put him over the legal limit. My husband argues that drinking one beer would put anyone over the legal limit. This makes no sense to me because then no one would be able to drive home after having a drink at a bar or restaurant. So, can someone tell me how they figure out your blood alcohol content and if one beer would make you over the limit? I believe the limit here is .008

If my husband was home from work I could answer that question for you. He used to be with the sheriff dept. Since I don't drink I can tell you that probably a half of a drink would do me in. hahaha My guess would be that they could charge him with DUI also only because they pulled him over and he was busted for one thing so now they can get him for both.
