I think deep down Derek's punishment was not so much the jail sentence but what happened to his brother at the end. Yes prison changed him for the better but losing Danny was his biggest punishment because he would have blamed himself. It would have been espcially tough because he and Danny had changed but the black boy who shot him would not have known this. If he had changed sooner or had not been racist at all then things would have been a lot different. The shooting was revenge for what Danny was and what Danny was was encouraged by Derek until he changed.
