No, it's legal because it is recognised as a valid spiritual path in a land which prides itself on religious freedom. It's the same here and in Britain (among others). Lash

Since witchcraft is based on pre-Christian paganism, it has nothing whatsoever to do with your God - or your devil, for that matter. It is recognised as a valid relgion in most Western countries. While not all practitioners worship the Goddess, the basis of most witchcraft is a balanced pairing of God and Goddess and a spiritual path that recognises the phases of the moon and the seasons of the earth and the sanctity of nature. What you call witchcraft is not what others call witchcraft. You are talking about devil worship not witchcraft. Wicca, which is what some people also call witchcraft, is a nature religion which existed long before Christianity. It is not black magic or devil worship. It is a common misconception of Christians to confuse the two things. Since Wicca is a recognized nature religion it is no more illegal than Christianity, Judaism, Hinduism, Buddhism or Islam. All of these can be practiced in America and Australia. We believe in religious freedom. Some followers of Wicca call themselves witches, they are the priestesses and priests of the religion. As to your comment above. I would ask whose God is it despised by? Wicca worships a Goddess and a God, Hindus worship many Gods, Buddhism worships no Gods as such. That just leaves Christianity, Judaism and Islam. Are you suggesting that Christianity should be the only religion allowed and that all other faiths should be persecuted and banned? I thought we had evolved beyond that petty narrow mindedness.
