What does the law says

Well my phone was tapped into and my private conversation with a friend was recorded and I am being threatend to be held responsible for talking about my husband's boss and his wife. I agree we talked about the incident that happened two days back and even exchanged our honest opinions about them, as we were scolded by his wife for not helping her out in the kitchen when we were invited for a party. And reaching two minutes late then the given time and not an hour before as we should have known we were supposed to help her out. That apart, I want to know specifically what are the laws about phone tapping in India and in your own country. I feel my fundamenta rights have been compromised as I am not the employee of his boss. And he had no business listening to a private conversation between me and my friend.

From what I understand a conversation cannot be recorded without the permission of one of the parties involved. It sounds to me that this was done illegally. Unless your friend knew about it. I would get legal advice on the matter and find out what channels to go through to find out why you were being tapped and who authorised it.

I also believe so and niether of us knew about it. With the events preceeding it that person has not played the contents back to us and I am wondering if he will ever dare to as he also knows its illegal to record our conversation without proper authority. We are planning to confront him in a day or two regarding this.

Countries have different laws, and in the US federal and states all have different laws. The basis of the laws is to protect the right to privacey. When telephones are involved it becomes even more difficult. In California you can tape phone conversations with either a court order, or if the party being taped is informed that the conversation will be taped. But again if we are talking face to face, I can record our conversation without your knowlege and its okay. So it depends on an expectation of privacey
