yamaha rhino owners

I have been seeing commercials on lawsuits on the yamaha rhino for flipping over. It's not the rhinos fault, it is the drivers fault so why sue yamaha? What are your thoughts on this? What about all the other quads and side by sides they flip too, but you don't see commercials on them about lawsuits. What gives?
