Is The Title Of A Book Copyrighted?

I just published a short story (it might be flash fiction actually) on Associated Content and it's on our church magazine blog as well. A friend just told me there is a book with the same title. Am I allowed to keep the title of my story or is a title of a book actually copyrighted? Any help is appreciated.

That Title of a book is not copyrighted, but if there is a similar book with the title that appears on the same site or is sold by the same publisher, that it is best to change the title. It depends. For instance, suppose you write a story titled, "Dangerous Limits" and there is a book called "Dangerous Limits" but it is published in Australia, then you would be all right, but supposing you write a fan fiction story called "Sadly She Moves" about Kay's forgetfulness on the Young and the Restless, and someone else writes another story with the same title on the Young and the Restless fan site, but this is about another character, then one of you will have to change the title to avoid confusion.

Thanks, my friend. That puts me a little at ease. I guess I should check titles next time.

Titles of books are not copyrighted. If you check on Amazon, you will notice there are frequently books with the same title. I noticed it most in the mystery section. Of course it isn't good to use the same title, but no one will come after you unless you have stolen the text as well. With an article, it probably matters less, although people who may want to read your article thinking it has something to to with the book of the same name may be disappointed. If you are just worried about inadvertently picking the same title, I don't really think you have anything to worry about, but I would try and avoid the practice in the future. You can always check your title with Amazon first. Good luck with your writing. Hope this helps.

I will definitely do a little research next time. Thanks for the info, my friend. I feel much less panicked.

Danielle Steel and Maeve Binchy both have written books titled "Echoes". So I'm pretty sure titles aren't copyrighted. For your own sake you would want to stay away from a title that is already out there to avoid confusion. You wouldn't want someone to purchase another author's book instead of your's because the titles are the same. Do a search first to see if there is a book out there with the same title that you would like to name your book.

Yeah, good point PatG. I'm definitely doing the searches and research on titles from now on. Oy! More research. My favorite thing to do.

You can't copyright titles of anything, books, songs, what have you. One of my favorite writing exercises is to go into a bookstore, write down titles that look interesting to me and use them in a new poem.

Good question. I don't think a title is copyrighted. Because there are lots of poems and stories about LOVE and such. I think it is copyrighted when it is an public name of a band. There are so many titles, it would be difficult not to somehow use the same one as that of someone else. But, I could be wrong. Someone on here will know for sure. Groetjes prettige Zondag.
