Here is my question on the nationality of a baby

So, if you and your pregnant wife flying on a plane to somewhere else other than within the U.S. border. Suddenly, your wife have a baby born on the plane; and the plane was flying on the international water area in the meantime. The question is, both you and your wife are not U.S. citizens, and what nationality does the baby belonng to?

Any sensible woman who is in her last trimester will not get onto a plane. A doctor will ask for the woman not to travel also in her last trimester. The altitude in the air will cause damage to water sac and sometimes put pressure onto the womb. if the parents are U.S. citizens then that baby would be a U.S. Citizen. If the parents are from England. Then that baby is an England citizen.

Well, what if in a sensitive time of situation. Let's not saying that plane departure from the United States, it might happen to other citizens of other countries. If that country was in war, and the people needed to evacuate from there. Would you wait for the baby been born there, or the parents been killed first.

That's a really good question. It would probably be whatever country governed the nearest border. It would be unlikely to happen because after a certain point in pregnancy you can not be on a plane at all, but it would be interesting to know the legalities behind it.

well I would think that leagally the baby would be a us citizen but then some countries will give the child duel citizenship too all very intresting , lol now i wanna call the airport! ~M~

I think the baby might get duel nationality like the one of his or her parents and the one of the country the plane was flying over. Airlines are not keen for babies to be born in the air. Therefore they require a letter of medical fitness to fly from about 28 weeks pregnancy and have a cut off of around 32 weeks. Each airline has slightly different rules.
