we're getting evicted and well, i hate to say it.....

But I'm actually glad to get away from this place. We have lived in a mold infested area for 4 years with management not doing a thing about it. I wish we didn't have to pay our rent because of it. And well we may be considering going to court and fighting this out. So this is the reason why I haven't been on here lately. I have been packing and watching our apartment to make sure they don't change the locks on us or take some stuff out of our apartment as well as talking to management of the apartments. Well, it has even got to were they threatened to throw us out if we didn't leave in 3 days. Well we found out that we have more than 3 days to move out and they don't have the right to throw us out. Until they have a court order. So well, now we are waiting on the date. But anyways, if I'm not on here for awhile, that's what going on. I should be able to get back on once everything is settled. And I'll be doing some job hunting and chatting it up on here. I will still come on here from now and then. But well pray that we find something good to live at and whether or not we should pursue it and take it to court.

I am sorry to hear about you getting evicted from your house and i know what you mean about the a condition of a place you have to live in.I was in private rent as a single parent and i had no hot water no heating as well as the mold and in the end i got a place to live as the place was making my children very ill all the time so i kept pushing all the time for help and in the end like i say i got to move to a better place.

Yep exactly I had gotten to that point myself before they even evicted us. And the eviction put the icing on the cake. We've had other problems as well, like water pouring down from the roof, we have neighbors above us and sometimes we'd go for days without water and we went for a whole year without a stove. But I'll be actually glad to get out of here. They tried throwing us out last week and well its against the law to make a tenant leave in three days after receiving a notice. We couldn't find anything still haven't, we may but we have to go check it out. But well sorry, can't force us to leave.

Have you documented the mold and also the fact that you reported it to management and they did nothing. That is not legal. I recommend that you go talk to someone at DHS. At the very least they might be able to get you out of paying rent. And the housing department might be able to find you an income-based property to live in.

We have a lot of documentation actually. We have pictures and even a message from apartments stating that they were sending maintenance over to fix the issue but they never come or they'll look at it and be like we'll put a work order in and that's about it. Seriously. It seems like no one cares any more. Would that really work for us to do that even now that we are getting evicted, I thought it would be too late, cause if not I'm calling tomorrow.

trisha27 yes I know about eviction boy do I know. my son is still out of work.11 months now. i am here in Gold c rest retirement home as we had no home after eviction, and he had no job, and only my social security between us. he got me put here so I would be safe, I am 83 with a bad leg he is in a neighboring town in gov. sponsored housing with three roommates so they cou ld have a place to live while they look for work. not too much fun here but its safe and its paid for with my soc ial security and SSi checks and i get a little back for my personal use. this economy is just horrid. hope you can get a really good job. my prayers go out to you andyours.

trishs27 do take it to court with the mold and all, youjust 'will probably win we were in a similar situation and would probably have won our case but my sons legal aid woman took that day to have an extra day off and my son not knowing all his rights lost the damned battle, so now I am in this damnable senior center while he is in a govpaid housing with three other guys all looking for work,our home was b roken up because a legal aid woman did not give a tinkers damn about us. well what goes around well one day come around. she will get what is due her i am sure.

On the mold issue, take lots and lots of pictures. Give your apartment mgr. the option to fix the mold. They have 30 days to comply. You shouldn't have to pay rent on an apartment that has mold in it. Make sure you get the pictures and hopefully thay have a date stamp on them. You may need to get a lawyer for this. Usually you can get a free meeting with a lawyer and the lawyer can tell you exactly what the laws are and possibly a lawsuit against the apartment complex for not getting rid of the mold or giving you another apt. I wish you the best of luck. My daughter lived in an apt. that had mold. I did take pictures and told the complex of the mold. When I told them that I had pictures of the mold, they let her out of her lease without any bad marks against her credit. Hope this helps a little.
