Help Please! Getting a record sealed and going to school for nursing.

Over 10 years ago I got a petty theft on my record. I never got into trouble after that. For all these years until the economy got bad, I never thought about it and never had a problem getting a job. Now, because of the economy, everyone does background checks and after many interviews I was told that they would rather hire someone with no record and no experience rather than someone who has mastered the position and a minor infraction on their record. I am in the process of sealing this record. My dilemma is this: I am currently a nursing student. They require a background check. Will my sealed record be seen. I know to a typical restraunt job, they will not be able to see it but I was told that the Nursing board does an FBI check. Does anyone know if they will see this? It's a misdemeaner 1, and $155 fine. I live in Ohio if that helps. If you could, please send a link or tell me who to talk to or where to go. I would hate to go through with all these classes and find out that I cannot possess a nursing job. Thank you to all that can help. I really need to know this as my clinicals are around the corner! Thank you again!

hi, let me start off by saying that is ridiculous that they would hire someone with no experience over you, just because you have that small petty theft on your record. i believe what you need to do is go down to the courthouse and ask the receptionist who you need to talk to to get it expunged from your record. 10 years is a long time, so i'm sure all you would have to do is talk to someone, and tell them your situation and they would likely take it off pronto. good luck. i would not be to worried about it, if it was 10 years ago, they will see that you have certainly straightend up your act since then

I feel you on the ridiculous part but it's happened. 41 interviews all said the same thing except one and I worked there before and they don't rehire. I am in the process right now getting it sealed. They said that it will be, so new job prospects are looking good. A local temp-agency said as soon as I get the order to seal back, they have a job waiting for me. That's a good thing. With 8 kids to feed its a very good thing. My problem is me going to school for nursing and not being able to be a nurse because of that. They should see that I was a young kid and stupid but have changed a lot of things since then. Wish me luck. I hope this works out!

Oh dear, didn't know it actually works like that! It's really stupid of them, and it's really not nice to behave like that to people. I mean, a 155$ fine? That's outragous. I hope everything is well with you.

That's cheap actually. The damages to the "victim" was only $9 and the rest were for court costs. I just paid $50 to seal the record, but I am afraid that all that is going to do is get me a regular job, rather than the nursing degree I am going for. Wish me luck!!

I'd call a lawyer and get a free consultation or call your local courthouse. Good luck.
